WCCO had been before the Council three <br />(3) times and they should have been advised to come before the <br />Council a fourth time. Mr. Miller explained that the 1988 CUP <br />contained conditions that required WCCO to clean up the site and <br />plant additional screening. An obnoxious outside telephone was <br />disconnected at the site. WCCO agreed to sell some of the <br />developable property when utilities are available. Mr. Miller <br />noted that things are not as bad at the site and that he is <br />working for the best interest of Lino Lakes. <br />Council Member Reinert explained that if for no other reason, the <br />CUP amendment allows the City to go back and clean up situations <br />which may have crept up over the years. <br />Council Member Bohjanen asked how many residents were notified <br />about this public hearing. It was noted that about twenty <br />residents were notified. Council Member Bohjanen asked if <br />findings of fact must accompany a denial of the CUP amendment. <br />Mr. Miller said six (6) findings of fact must be provided. <br />Mr. Swanson asked if it would make a difference if he surveyed <br />people within sight of the Doppler radar installation to get the <br />owners to provide more detailed information regarding health <br />concerns. <br />Council Member Bohjanen asked how many residents contacted WCCO <br />about the installation. Mr. Smith said one (1) person. He also <br />met with some of the neighbors. Mr. Stromen said that he talked <br />with several neighbors who said they would have attended the <br />meetings prior to the installation when somdthing could have been <br />done about it. They feel that they cannot fight big business. <br />Council Member Bohjanen moved to close the public hearing at 9:00 <br />P.M. Council Member Kuether seconded the motion. Motion carried <br />unanimously. <br />Mr. Hawkins explained to the Council that their decision on this <br />matter must be based on criteria outlined in the City Code. He <br />also said that he understood the public interest in the matter, <br />but Mr. Miller did have latitude in the matter. Mr. Hawkins said <br />that the Council will have to find specific findings of fact for <br />either approval or denial of the CUP. <br />Council Member Bohjanen said that after hearing all the legal <br />aspects of the matter and the City Planner's reply, he felt that <br />WCCO should have gone through all the "ropes" and moved to <br />approve DRB Application No. 90 -58 for the installation of the <br />Doppler radar and direct the staff to prepare finding of fact in <br />support of this motion.
