1 <br />COUNCIL MEETING FEBRUARY 27, 1989 <br />Update, Nelson Lawsuit - Mr. Hawkins explained that a number <br />of lots in Lakes Addition No. 3 on the east side of Black <br />Duck Drive have become tax forfeit. The City made <br />arrangements to purchase the lots and did advertise them for <br />sale noting that some of the lots were unbuildable because of <br />high ground water. Mr. Nelson was the successful bidder on <br />the lots. He then determined that it was not to his best <br />interest to purchase the lots and notified the City of his <br />decision. The City started court action to force Mr. Nelson <br />to complete the terms of the bid. Mr. Nelson then sued the <br />City alleging the lots were unbuildable. The court has <br />awarded in favor of the City and Mr. Nelson is now going <br />through the process of obtaining the necessary permits and <br />approvals for building. He has applied to the Planning and <br />Zoning Board for variances to set backs on several lots and <br />vacation of easements on several lots. Mr. Hawkins noted <br />that the P & Z Board is recommending that the variance <br />requests not be granted. However, when these lots were <br />placed out for bid, the City was aware some variances would <br />be required to make the lots buildable thus allowing the City <br />to recoup Some of the assessments on these lots. Later on <br />this agenda the Council will be setting a public hearing for <br />March 27, 1989 for the vacation of easements request. <br />PLANNING AND ZONING REPORT - JOHN MILLER <br />Set Public Hearing, Preliminary Plat for Richard E. Shope, <br />Jr. for March 27, 1989, 7:30 P.M. - Mr. Bohjanen moved to set <br />this public hearing. Mr. Neal seconded the motion. Motion <br />carried unanimously. <br />Set Public Hearing, Vacation of Easements, Roger Nelson for <br />March 27, 1989, 7:45 P.M., Resolution No. 12 - 89 - Mr. Bisel <br />moved to set the public hearing and approve Resolution No. 12 <br />- 89. Mr. Bohjanen seconded the motion. Motion carried <br />unanimously. Resolution No. 12 - 89 can be found at the end <br />of these minutes. <br />Set Public Hearing, Rezone for Henry Laska, 831 Lake Drive <br />for March 27, 1989, 8:00 P.M. - Mr. Bohjanen mo ed to set <br />this public hearing. Mr. Bisel seconded the motion. Motion <br />carried unanimously. <br />Set Public Hearing, Preliminary Plat, Woodridge Estates II <br />for March 27, 1989 at 8:15 P.M. - Mr. Bisel moved to set this <br />public hearing.
