50 <br />December 27, 1977 <br />The Personnel Commission will start on a personnel policy, This should be <br />completed this coming year. Sgt. Costa had appeared to express his displeasure <br />at the manner in which the Council removed the Sargents' rating. He had not <br />remained at the meeting to discuss this matter. The matter was discussed by the <br />Personnel Commission and it was pointed out this had been discussed at several <br />meetings in the past year including a meeting with the Union. <br />Mr. Schneider pointed out this was left open, if the need is there and can be <br />supported, this decision can be reversed. <br />Mr. Zelinka reminded the Council taht one member of thePersonnel Commission will <br />need to be replaced. <br />Mr. Locher had checked the dog ordinance and it does not include the notice <br />provision, but this provision could be a part of the contract. <br />Mr. Zelinka moved that a notice provision be required as part of the contracts. <br />Seconded by Mr. Karth. Motion carried unanimously. <br />Mr. Locher presented a complaint he had received about removal of diseased <br />trees on the Tobish property. It seems there were four trees to be removed, Mr. <br />Tobish had removed three and the fourth had blown down on the adjacent property <br />owner's property creating a problem. Mr. Locher had advised the complaintant to <br />clean up and sue Mr. Tobish in small claims court. <br />Mr. Locher pointed out there is no penalty provisions in the rules as set up by <br />the Agricultural Department. If the owner does not remove the trees, the City may <br />remove and assess this costs against the property. <br />Mr. Locher had checked the proposed plat, MarDon, and had found the power company <br />has a blanket easement on that property. This will have to be reduced to an exact <br />description before the :plat can be approved. Mr. Locher said the land under the <br />line may be used for storage buildings or gardens, but homes may not be constructed <br />within the easement. <br />Mr. McLean felt the Planning and Zoning will require a one acre lot outside the <br />easement. The land owner may sell lands within the easement to the purchases, if <br />he so desires, but this would be over and above the required one acre. <br />Mr. Locher said a map he had consulted, showed a 45' easement on either side of <br />the line. However, he did not know if this is from the encter of the line, or if <br />this is from the edge of the lines. He had also seen one sketch showing a 200' <br />easement. <br />Mr. McLean said a definition of this easement will be necessary, and the lots must <br />have one acre of clear land. <br />Under Old Business, Mr. Zelinka noted the Council members spend a lot of time at a <br />Council meeting checking bills and requisitions. He suggested the Council meet <br />prior to the regular convening time to check these items in the Clerk's office and <br />question any items not understood. <br />Mayor Bohjanen said this had been tried at one time and had not worked out. However, <br />he felt that if something can be worked out, it is a good idea. <br />Mr. Karth moved to set a special Council meeting for January 4, 1978 at 8:00 P.M. <br />for the purpose of filling all Board positions and orginzaing the Council for the <br />coming year. Seconded by Mr. McLean. Motion carried unanimously. <br />
