199 <br />December 11, 1978 <br />Mr. Zelinka suggested a letter to Mr. Mobley from Mr. Manning stating <br />that his views on the usage of the building are in error and that no <br />intended commercial usage is planned by the owner. This fact should be <br />certified to the building inspector, and also, if Mr. Manning should ever <br />decide to change the usage, it would have to be cleared through the Plann- <br />ing and Zoning Commission and the City Council. <br />Mr. Locher said the complaint must be filed by December 25, 1978. He <br />felt there is a breakdown in communications. The red tags had been removed <br />and the construction continued. Mr. Locher told Mr. Manning he would have <br />to pay a double permit fee. <br />Mr. Manning was asked if he could provide plans and he said he had some <br />specs. He was advised to contact Mr. Gotwald on providing complete plans <br />and pass these suggestions on to Mr. Mobley. <br />Mr. Locher will contact Mr. Mobley and see if this matter can be resolved <br />out of Court. <br />Mr, Brian Dobie was in the audience to discuss his development just North <br />of Main Street, and the City's acceptance of the right -of -way. <br />Mr. Locher had checked the abstract and the legal description for the <br />street and everything was in order. There are a couple of items that were <br />different, but this is a matter of correcting the actual drawings. The <br />Acceptance of the street right -of -way is necessary for the filing of <br />deeds for the parcels of land with the correct legal descriptions. It <br />also eliminates the necessity of including an easement for street purposes <br />on each parcel of land. <br />Mr. McLean moved to accept the street right -of -way as laid out and described <br />in the Dobie Development. Seconded by Mr. Zelinka. Motion declared passed. <br />There was discussion on the method of providing escrow monies for the in- <br />stallation of the street. This will be decided at a later date. <br />Mr. Schneider said that he had more work to do on the final budget. It <br />seems the $10,000.00 to be set aside for the possibility of a City <br />Administrator is not in the budget. This matter is to be on the Dec. 26, <br />1978 agend. <br />There was some discussion on a different method of compensating the Build- <br />ing Inspector. The general feeling of the Council was that all permits <br />must be final before payment is made. Any other method must be cleared <br />through the Council. <br />There was no Police Advisory Board report. The next meeting is scheduled <br />for December 12, 1978. The report on the meeting of the Personnel <br />Commission was deferred until Mr. Kulaszewicz could be present. <br />Mr. Zelinka reported on the last meeting of the Park Board. They had re- <br />qested Mr. Locher to check the legality of requiring money for Park pur- <br />poses on all building permits. <br />Mr. Locher had checked this out and found that the Cities only have the <br />authority given them by legislation. This allows up to 10% on platted <br />lands but makes no provisions for other parcels. Mr. Locerh said there <br />are Cities requiring this at the present time, but the Attorney at the <br />League of Cities felt that if it was ever tried in Court, the Cities would <br />
