Mr. Locher made note of the limits <br />within the law and Mr. Neff said they were aware of the restrictions. <br />Mr. Kulaszewicz moved to approve this permit subject to the receipt of <br />the Bond and in accordance with the letter submitted by the VDW, that <br />profits will be used for Community service projects. This permit to <br />become effective thrity days from the date of application, which was <br />April 24, 1979. Seconded by Mr. Zelinka. Motion declared passed. <br />Mayor Karth questioned the permit fee - no schedule is on file for this <br />kind of permit. The general consensus of the Council was there should <br />be no fee to this orginazation. <br />The W. &.G. Rehbein plat hearing was called to order at 10:00 P.M. Mr. <br />Locher read the notice of legal publication. <br />The matter of the cul -de -sac on Lot 4, Block 1, was discussed. That lot <br />will still be of legal size with teh acreage of the cul -de -sac removed. <br />Mr. Don Marier questioned the drainage of this parcel of land. He felt <br />that the water from the Eastern portion of the land will drain to the North <br />onto his property and into Peltier Lake, thus casuing polution of that <br />lake. He presented a petition signed by abutting landowners protesting <br />this development. He also asked for a copy of the Ordinance requiring <br />notification of adjacent property owners in the instance of a public <br />hearing on platting. <br />III Mr. Locher said that notification of adjacent property owners of the <br />possibility of a plat being considered for an area is not required - Just <br />publication of the notice in the City's legal newspaper. <br />Mayor Karth read the petition. Mr. Marier said they would ask for Rice <br />Creek Watershed Board's recommendations. They felt this Board's input <br />is needed. Mr. Marier felt the drainage of most of this area drains into <br />a ditch, which in turn drains to the North into Peltier Lake. <br />Mr. McLean moved to continue thi hearing pending a recommendation from <br />the Rice Creek Watershed Board, recognizing the area citizens concern. <br />This hearing to be rescheduled for 8:30 P.M. on June 11, 1979. All persons <br />on the petition and Mr. Rehbein will notified if the hearing will be held. <br />Seconded by Mr. Kulaszewicz. Motion declared passed. <br />Mr. Mike Huberty, representing Mr. Glenn Rehbein, asked for an extension <br />to the requirements of filing a plat. Shenandoah III had been approved <br />6/25/77 but had not been filed. <br />Mr. Locher read that portion of the Ordinance dealing with this matter <br />and noted that if a plat is not filed within 90 dyas, technically the <br />plat is null and void. <br />Mr. McLean moved to deny the request and submit to the Planning and Zoning <br />for review on May 16, 1979, put before the Council on May 29, 1979 and <br />III set a public hearing for June 11, 1979 (time will established at the May <br />29, 1979 meeting). Seconded by Mr. Zelinka. Motion declared passed. <br />Mr. Schneider gave a report on the financial status of the City. He also <br />indicated that Mr. Kelly has the information requested by the Council. <br />Mr. Shneider moved to set a special meeting for May31, 1979 at 8:00 P.M. <br />
