1 May 14, 1979 24 Mr. Neff said this would be provided. Mr. Locher made note of the limits within the law and Mr. Neff said they were aware of the restrictions. Mr. Kulaszewicz moved to approve this permit subject to the receipt of the Bond and in accordance with the letter submitted by the VDW, that profits will be used for Community service projects. This permit to become effective thrity days from the date of application, which was April 24, 1979. Seconded by Mr. Zelinka. Motion declared passed. Mayor Karth questioned the permit fee - no schedule is on file for this kind of permit. The general consensus of the Council was there should be no fee to this orginazation. The W. &.G. Rehbein plat hearing was called to order at 10:00 P.M. Mr. Locher read the notice of legal publication. The matter of the cul -de -sac on Lot 4, Block 1, was discussed. That lot will still be of legal size with teh acreage of the cul -de -sac removed. Mr. Don Marier questioned the drainage of this parcel of land. He felt that the water from the Eastern portion of the land will drain to the North onto his property and into Peltier Lake, thus casuing polution of that lake. He presented a petition signed by abutting landowners protesting this development. He also asked for a copy of the Ordinance requiring notification of adjacent property owners in the instance of a public hearing on platting. III Mr. Locher said that notification of adjacent property owners of the possibility of a plat being considered for an area is not required - Just publication of the notice in the City's legal newspaper. Mayor Karth read the petition. Mr. Marier said they would ask for Rice Creek Watershed Board's recommendations. They felt this Board's input is needed. Mr. Marier felt the drainage of most of this area drains into a ditch, which in turn drains to the North into Peltier Lake. Mr. McLean moved to continue thi hearing pending a recommendation from the Rice Creek Watershed Board, recognizing the area citizens concern. This hearing to be rescheduled for 8:30 P.M. on June 11, 1979. All persons on the petition and Mr. Rehbein will notified if the hearing will be held. Seconded by Mr. Kulaszewicz. Motion declared passed. Mr. Mike Huberty, representing Mr. Glenn Rehbein, asked for an extension to the requirements of filing a plat. Shenandoah III had been approved 6/25/77 but had not been filed. Mr. Locher read that portion of the Ordinance dealing with this matter and noted that if a plat is not filed within 90 dyas, technically the plat is null and void. Mr. McLean moved to deny the request and submit to the Planning and Zoning for review on May 16, 1979, put before the Council on May 29, 1979 and III set a public hearing for June 11, 1979 (time will established at the May 29, 1979 meeting). Seconded by Mr. Zelinka. Motion declared passed. Mr. Schneider gave a report on the financial status of the City. He also indicated that Mr. Kelly has the information requested by the Council. Mr. Shneider moved to set a special meeting for May31, 1979 at 8:00 P.M.
