<br />Whereas, r:trhas City Council hereby determines that the following portion
<br />of utility easements Tying within the corporate limits of the City of Lino Lakes
<br />Anoka County, Minnesota, described as follows, to -wit:
<br />A Utility easement as shown on the plat of Twilight Acres, according to the
<br />map or plat thereof on file and of record in tthe office of the County
<br />Recorder, Anoka County, Minnesota, over a strip of land 10 feet in
<br />width, as measured at right angles, parallel with and adjacent to and
<br />Northeasterly of the Southwesterly line of Lot 2, Block 2, of said sub-
<br />division,
<br />and,
<br />A utility easement as shown on said plat, over a strip of land 10 feet
<br />in width parallel with and adjacent to and lying Northeasterly of the
<br />Southeasterly line of Lot 3, Block 2, of said subdivision, except that
<br />part thereof Tying South of a line parallel with and distant 10 feet
<br />North of the Southerly Line of said Lot 3, Block 2,
<br />has not formerly been used for public purposes, has not been needed for public
<br />purposes; and
<br />WHEREAS, after. due consideration, at a public hearing held on May 14,
<br />1979, at 11:30 o'clock, P.M. ,;'at the City Hall in the City of Lino Lakes, by the
<br />City Council of the City of Lino lakes, Anoka County, Minnesota, this City Council
<br />determines that the vacation of said portion of utility easements will in no
<br />be detrimental $o the public interest, and that it will be in the interest of the
<br />public to vacate said portion of utility easements;
<br />NOW THEREFORE. BE IT RESOLVED, by the City Council of the City of Lino
<br />Lakes, Anoka County, Minnesota as follows:
<br />That the following described portion of yatility easements Tying within
<br />the corporate limits of the City of Lino Lakes, Anoka County, Minnesota, described
<br />as follows, to -wit:
<br />A utility easement as shown on the plat of Twilight Acres, according to
<br />the map or plat thereof on file and of record in the office of the
<br />County Recorder, Anoka County,HMinnesota, over a strip of land 10 feet
<br />in width, as measured at right angles, parallel with and adjacent to
<br />and Northeasterly of the Southwesterly line of Lot 2, Block 2, of said
<br />subdivision,
<br />and.
<br />A utility easement as shown on said plat over a strip of land lo feet
<br />in width barallel with ana adjacent to and lying Northeasterly of the
<br />Southeasterly line of Lot 3, Block 2, of aaid subdivision, except that
<br />part thereof Tying South of a line parallel with and distant lo feet
<br />North of the Southerly line of sale Lot 3, Block 2,
<br />shall be and is hereby vacated as of the date hereof.
<br />The motion for the adoption of the foregoing resolution was duly seconded
<br />by Councilman Kulaszewicz, and upon vote being taken thereon the following voted in
<br />favor thereof: Mayor Harvey Karth and Councilmen Richard Zelinka, John McLean, Rob-
<br />ert Schneider, and Richard Kulaszewicz,
<br />and the following voted against the same: none.
<br />Whereupon the said resolution was declared duly passed and adopted.
