Had there been equal petitioning, the Council would <br />have had the choice of approving the improvement or denying the <br />improvement. As matters currently stand, the Council must deny <br />the improvement and deny Resolution No. 25 - 91. <br />Council Member Kuether moved to deny Resolution No. 25 - 91. <br />Council Member Bohjanen seconded the motion. Motion carried <br />unanimously. <br />Resolution No. 25 - 91 can be found in the resolution book. <br />PUBLIC HEARING TO TARE PUBLIC COMMENT REGARDING ADOPTION OF <br />INTERCHANGE LAND USE AND MARKET STUDY AS A COMPREHENSIVE PLAN <br />AMENDMENT <br />Mr. Miller explained that the Freeway Interchange Land Use and <br />Market Study is a comprehensive plan amendment for land adjacent <br />to the city's two (2) freeway interchanges. The plan makes <br />specific recommendations for development in areas adjacent to <br />both interchanges. Mr. Miller noted that the property owners <br />were included in the preparation of the plan and meetings with <br />them were held last summer. <br />The draft plan has been reviewed by the DRB and the EDC and both <br />recommend approval of the plan. Mr. Miller noted that the plan <br />makes specific recommendations regarding development. He <br />outlined the five (5) specific recommendations: 1) the need for a <br />"Planned Development" overlay for the full interchange areas; 2) <br />any proposal for a gasoline service station by definition must be <br />part of a larger "Planned Development "; 3) require roadway re- <br />alignments to better serve both interchange sites; 4) extend the <br />Rural - Business Reserve District to Main Street at the I -35E <br />interchange, and 5) emphasize commercial /retail development at <br />the I -35W site and industrial development at the I -35E site with <br />supporting retail and service activities. <br />Mr. Miller used the overhead projector to outline the study areas <br />at I -35E and I -35W. He particularly noted the proposed re- <br />alignment of Lilac Street because of the concern by the state and <br />county regarding the short distance of this street from I -35W. <br />This would allow for better use of the land at the northwest <br />corner of that freeway. <br />Acting Mayor Reinert opened the public hearing at 7:53 P.M. <br />There was no comment from the public. Council Member Kuether <br />moved to close the public hearing at 7:54 P.M. Council Member <br />Bohjanen seconded the motion.
