304 <br />Council Member Reinert noted that a coordinator has not been <br />hired for the tri -city recreation program. Mr. Volk explained <br />that the last information he had was that all funding was placed <br />on hold until 1992. The program will be re- evaluated at that <br />time. Council Member Reinert suggested selling some of the <br />services and time of the Lino Lakes recreation director to <br />neighboring communities. Mr. Volk said he would investigate this <br />possibility. <br />Mayor Bisel said that the comments he has heard regarding the <br />Lino Lakes recreation program and Mr. Bernstein have been very <br />favorable. He also noted that most of the supervising staff are <br />area youth and this provides additional work for local youth. <br />Council Member Kuether moved to approve the recommendation of the <br />Public Works Director to include the recommendation by Council <br />Member Reinert regarding sharing services with surrounding <br />communities. Council Member Neal seconded the motion. <br />VOTING ON THE MOTION: <br />Bisel <br />Neal <br />Bohjanen <br />Reinert <br />Abstained: none. <br />Motion carried unanimously. <br />ATTORNEY'S REPORT <br />Kuether <br />Mr. Hawkins updated the Council regarding several lawsuits that <br />are pending. Mr. William Boop has filed a lawsuit against <br />adjacent property owners and the City regarding a septic system. <br />This matter has been referred to the insurance company who will <br />be handling the proceedings. <br />The Homeowners Association of Otter Lake Estates has filed a <br />lawsuit regarding the Oak Brook Peninsula preliminary plat. This <br />lawsuit has been referred to the insurance company and they have <br />accepted responsibility and will defend the City. <br />Mr. Paul Howard has sued the City because the City has refused to <br />rezone property that he owns. This matter has also been referred <br />to the insurance company and they are defending the City in this <br />matter. A trial will probably be conducted at the end of this <br />year or the beginning of 1992. <br />CONSIDERATION OF CITY PARTICIPATION IN ELEMENTARY SCHOOL <br />UNDERPASS <br />Mr. Schumacher explained that he is asking the Council for <br />direction in this matter.
