148 <br />COUNCIL MINUTES MARCH 9, 1992 <br />hiring 14 Judges from the list. Council Member Kuether moved to <br />approve the list. Council Member Neal seconded the motion. <br />Motion carried unanimously. <br />Recognition of Departing Park Board and Planning and Zoning Board <br />Members - Council Member Kuether suggested that the City <br />recognize former Park and Planning and Zoning Board members by <br />giving them a certificate or plaque. It would be a recognition <br />of the time spent in service to their community. <br />Council Member Neal moved to give former Park Board and Planning <br />and Zoning Board members plaques in recognition of their <br />services. Council Member Kuether seconded the motion. Motion <br />carried unanimously. Mr. Schumacher will order the plaques and <br />let the Council know when they are ready for presentation. <br />Soliciting Bids for Lawn Mowing - Council Member Elliott <br />suggested that the Council discussion securing bids from the <br />private sector for lawn mowing for next season. This matter will <br />be placed on a Council work session agenda. <br />The Council adjourned at 9:21 P.M. to a closed session to discuss <br />the Arcon Litigation and returned at 9:42 P.M. <br />Arcon Litigation, Retainage Alternatives - Mr. Hawkins explained <br />that the Council just met in a closed session and discussed this <br />matter. Arcon Construction Company is requesting that the City <br />pay them the 5% retainage from the Reshanau Trunk Sewer <br />Improvement in lieu of a bond or other acceptable security. This <br />procedure is acceptable and does allow Arcon to provide such <br />security as a Certificate of Deposit on which they will earn <br />interest. The City is also protected since the security must be <br />pledged to the City until the City releases it. <br />Council Member Kuether moved to approve an escrow agreement and <br />payment to Arcon Construction Company. Council Member Elliott <br />seconded the motion. Motion carried unanimously. <br />Council Member Kuether moved to adjourn at 9:44 P.M. Council <br />Member Elliott seconded the motion.
