COUNCIL MEETING JUNE 26, 1995 <br />Minor Subdivision, Harvey Meredith, 8301 - 20th Avenue - Ms. <br />Wyland used the overhead projector to show the location of this <br />property. <br />Mr. Meredith owns 30 (29.4 + / -) acres on the west side of 20th <br />Avenue just south of the Columbus Township border. He would like <br />to subdivide the site into three (3) building sites. The <br />property is zoned Rural and a 10 acre minimum lot size is <br />required with a minimum lot width of 330 feet. The zoning in <br />Columbus Township, adjacent to this site, is also rural with a <br />five (5) acre minimum lot size. The Lino Lakes Comprehensive <br />Land Use Plan indicates this property as rural. Utilities are <br />not available to serve the site. <br />Mr. Meredith is proposing the following: <br />Parcel A <br />Parcel B <br />Parcel C <br />- 10 acres with 374.61 feet of lot width on 20th <br />Avenue <br />- 9.4 acres with 343.62 feet of lot width on 20th <br />Avenue <br />- 10 acres with 330 feet of lot width on 20th <br />Avenue <br />Parcel D - <br />.03 acres physically separated from the balance <br />of the property by I35W <br />A variance is being requested for parcel B for .6 acres. <br />According to the Zoning Code, "variances from the literal <br />provisions of the ordinance may be granted in instances where <br />their strict enforcement would cause undo hardship because of <br />circumstances unique to the individual property under <br />consideration ". The City must make findings of fact that: <br />A. That the property in question cannot be put to a <br />reasonable use if used under conditions allowed by the <br />official controls. Mr. Meredith has the ability to <br />split the parcel into two (2) lots rather than three <br />(3) lots. Therefore a reasonable use of the property <br />exists. <br />B. That the plight of the landowner is due to <br />circumstances unique to this property not created by <br />the landowner. In this case, when I35W was <br />constructed, public action was required to take a <br />portion of this property for highway purposes. Prior <br />PAGE 10 <br />1 <br />
