Mr. Gotwald had taken a look at the roads and they <br />looked very good to him. <br />Mr. Locher read a letter from the Minnesota Pipeline Co. assuring the <br />Village that the ball diamond fence and playing field would be restored <br />to our satisfaction when the work is completed on the pipeline. He <br />could not get the 66' easement reduced. The company maintains they <br />need that much area. <br />Mr. Locher said there should be two resolution passed tonight. One to <br />allow the crossing of Village streets throughout the Village. Mr. <br />Zelinka so moved. Seconded by Mr. Jaworski. Motion carried. <br />The Council had consulted the maps as to where this line would cross <br />Village streets. The pipeline crosses Pine Street and possibly 24th <br />Ave. , There was some question on whether it would cross East Rondeau <br />Lake Drive. <br />Mr. Zelinka moved to authorize the Mayor and the Clerk to execute the <br />agreement. Seconded by Mr. Jaworski, Motion carried. <br />Mr. Locher had also received a copy of the Metro Council's answer to <br />the suit on the SAC. He also reported on action taken by the Humane <br />Society and the Village against the Birchwood Hills Stables. A'search <br />warrant had been obtained and was served by a Deputy Sheriff. They <br />found three Black & White Holstein calves in a very dehydrated condition. <br />The animals were impounded and taken to the U of M. Samples of the feed <br />was also taken. Mr. Locher seemed to think this would help clear up <br />the situation at that location. <br />Mr. Jaworski brought up the subject of the Flag flying for 24 hours <br />per day. The one up now is beginning to fray. <br />Mr. Bohjanen said the VFW has a new one ready to be put up, and they will <br />continue to replace the Flag whenever necessary. <br />Mr. Jaworski wondered if the vote taken authorizing the flying of the <br />Flag for 24 hours was a legal vote. There were only four members pre- <br />sent at that Council meeting with two voting for, one against, one <br />abstaining. A majority of the quorum present is necessary to pass a <br />motion. Mr. Jaworski said that he will not vote on this issue again. <br />Whether the Flag flies 24 hours a day or only during office hours is <br />up to the Council. <br />Mr. Bohjanen s a i d the Flag w i l l be rep I ace as often as necessary by the <br />VFW and since the flagpole and the Flag are gifts to the Village, he <br />felt that the Council should yeild to the wishes of the people who made <br />the gifts. Mr. Bohjanen moved #o fly the Flag for 24 hours a day. <br />Seconded by Mr. Zelinka. Roll call vote; Mr. Cardinal, No; Mr. Jaworski, <br />abstain; Mr. Zelinka, Yes; Mr. Bohjanen, Yes. Motion failed for lack <br />of a majority. <br />
