1 <br />1 <br />Mr. L'Allier called for a motion on whether Circle Pines is or is not in <br />violation of the franchise or ordinance as it relates to the addition and /or <br />extension of their lines without permission of the Council. <br />Mr. Jaworski moved that the Council go on record as finding Circle Pines in <br />violation of ordinancd #28 and /or 29 in not appearing before the Council for <br />prior approval of addition or extension of their lines. Seconded by Mr. <br />Bohjanen. Vote: W. Jaworski -Aye, Mr. Cardinal--Aye, W. Rosengren--No, <br />Mr. Bohjanen--Aye, Mr. L'Allier -Aye. Motion carried. <br />Mayor L'Allier called for a motion relating as to whether or not we approve <br />or disapprove of the action of Circle Pines Utilities in extending their <br />lines to cross existing lines to duplicate service in an area already serviced, <br />and if we do or, do not approve they be granted or not granted permission to <br />service Molin Concrete. <br />Mr. Bohjanen moved to deny to the Utilities Commission of, Circle Pines the <br />right to extend their lines in Lino Lakes as to crossing service lines put <br />in by North Central on Lilac Street as such complies with the resolution <br />previously recommended by the Council. <br />After discussion the motion was read again. Mr. Bohjanen was willing to put <br />in the phrase, "disapprove of the action." There was no second to the motion, <br />The Mayor called for, another motion. <br />Mr. L'Allier moved that the Council disapprove of the action of Circle Pines <br />Utilities extending their lines to service Molin Concrete and that we <br />specifically request that they do not service the Molin Concrete plant. <br />Seconded by W. Bohjanen. Vote: Mr. Jaworski—Aye, W. Cardinal- Aye, Mr. <br />Rosengren - -No., W. Bohjanen- -Aye, Mr. L'Allier -Aye. Motion carried. <br />W. L'Allier stated that if there were no objection, the Clerk would transmit <br />the sum and substance of this action to Circle Pines Utilitis, Molin Concrete <br />and North Central Public Service Co., with carbon copies to the Council mem- <br />bers and to the attorneys who were here this evening and last Monday, namely, <br />Mr. Burstein and Mr. Simon. <br />Mr. L'Allier stated that he wished for ratification of this time of unofficial <br />action taken after the special meeting (Aug. 16th) to authorize the Planner to <br />proceed with, a preliminary zoning map; he asked Mr. Gotwald to bring us up to <br />date on the map. <br />Mr. Gotwald mentioned that the State had passed a law requiring communities <br />to be involved in a comprehensive use plan for extension of sewer trunk <br />lines. The Metro Sewer Board has included in their program for the next <br />2 years an extension of an interceptor to Centerville. All other requirements <br />for this interceptor were met in both Lino Lakes and Centerville except our <br />comprehensive use plan which is presently holding them up. <br />Mr. Gottwald stated that he had talked with Mr. Dohorty who realizes that the <br />community has not completed a comprehensive plan but is satisfied that we are <br />working on same. He requires a map showing what we have done to date for thier <br />file. Mr. Gotwald noted that zoning maps are subject to change since. zoning <br />plans are in a state of flux. <br />Mr. Gotwald commented on payment of Metro Sewer charges, suggesting that we <br />include a hookup charge to help pay for the Metro charges. He thought that <br />a copy of a preliminary zoning map plus a resolution authorizing same, and a <br />statement from the Planner would handle the requirements for present. W. <br />
