'4 <br />10/12/71 <br />A note will be given to Mr. Backlin to check these out. lair. L'Allier stated <br />that he had received one new application for the part -time police position and <br />that a couple more were coming. He stated that he and Mr. Myhre would go over <br />the applications and report at the next meeting. <br />Mr. Rosengren moved to pay the bills as audited. Seconded by Mr. Cardinal. <br />Carried unanimously. <br />Mr. Jaworski moved to adjourn at 9:02 P.M. Seconded by W. Rosengren. Aye. <br />Mr. Floyd Miller stood up and asked if the Council wasn't going to discuss his' <br />request which had been made on a roadway easement which he thought had been on <br />the agenda. <br />Mr. L'Allier reopened the meeting at 9:03 P.M. <br />Mr. Miller wished to have the Council accept a dedication of roadway easements <br />for the private road by his shop. 'Mr. Locher stated that he had talked to Mr. <br />Miller on this and had advised Mr. Miller to prepare a petition that the <br />Council accept the roadway deeds of dedication for partial maintenance. Floyd <br />stated that he had talked to the other property'owners and all were agreed. <br />Mr. Miller's °attorney, Mr. Hiniker, had sent a letter to the Council dated <br />October 12, 1971, requesting that the Council agree to take a Deed'of Easement <br />for partial easement of a street over the following described property: The <br />Southerly 66 feet of the NW 1/4 of the SW 1/4 of Section 3, T 31, R22, Anoka <br />County. There are presently four residences on the roadway, the owners being <br />Kenneth Miller, Floyd Miller, Virgil Lundberg and Alvin L. Roetman. Mr. <br />Hiniker requested that the matter be referred to the Village Engineer and the <br />Village Attorney for inspection. Floyd stated that he had talked to Mr. <br />McLean who had recommended going this route. <br />Mr. Bohjanen moved to refer the matter to the Engineer and the Attorney. <br />Seconded by Mr. Rosengren. Carried unanimously. Mr. L'Allier asked Floyd to <br />leave copies of the maps for the officials. Floyd noted that the road had been <br />approved once by the P&Z. The Clerk was instructed to check the records to <br />see what status the road had. Mr. Locher noted that he had told Mr. Hiniker <br />that the easements could only be taken over for partial maintenance and that <br />if the adjoining landowners wished to have the road approved then it would <br />be on an assessment basis. <br />Floyd noted that 2 of the parties involved were selling their homes so it would <br />entail a wait. He stated that he also needs variances for parcels of less than 2 1/2 <br />acres. lair. L'Allier told him that he would have to go before the P&Z with a <br />metes and bounds legal description. There was discussion on which should <br />occur first, acceptance of the road or the variances. Mr. Gotwald stated that <br />there would be no problem if the road was accepted first. He thought there <br />were special conditions when Rehbein platted the driveway. <br />After discussion, Mr. Jaworski moved to refer the matter to the P&Z at their <br />November meeting or at the October meeting if reports were received in time <br />from the Engineer, Attorney and the Clerk,`the' first 2 reports to be sent <br />directly to the P&Z with copies to the Council; also that the Clerk inform <br />Mr. Miller at which meeting the hearings would be held. Seconded by Mr. <br />Rosengren. Carried unanimously. <br />Mr. Bohjanen moved to adjourn at 9:13 P.M. Seconded by Mr. Jaworski.
