976 <br />July II, 1977 <br />Mr. Locher reported on the problems with the property located on 4th Avenue North of Main <br />Street. The Building Inspector had denied a building permit on one parcel of the land <br />and had red tagged another construction site. Mr. Gotwald had inspected this property and <br />had recommended that the land be inspected and tested by an independent soil testing lab- <br />oratory. In the interium, he felt a Resolution supporting the Engineer and the Building <br />Inspector in their actions should be passed by this Council. Mr. Zelinka so moved. Se- <br />conded by Mr. Karth. Motion carried unanimously. <br />Mayor Bohjanen said the red tagg holds and there is to be no more construction on this <br />property until this lab report is in and studied. <br />Mr. Zelinka moved to hold all building permits until the final report for the entire 80 <br />acres is received. Seconded by Mr. Karth. Motion carried unanimously. <br />The Clerk was instructed to write to Mr. Van Kleek with this information. <br />Mr. Locher reported on the release of information from Personnel files - except for social <br />security numbers, juvenile offenders and voter registration information, all else is public <br />information. <br />On the parking ticket that was given to Mr. Locher at the last Council meeting, Mr. Locher <br />recommended dismisal of this due to the fact that the officer did not observe the car being <br />parked by the person the ticket was issued to and he felt that the City did not have a case. <br />Mr. McLean moved to dismiss the ticket. Seconded by Mr. Zelinka. Motion carried unanimously. <br />Mr. Locher had presented suggestions for possible ordinances and Mr. Zelinka moved these <br />be put on the agenda for the next Council meeting. Seconded by Mr. McLean. Motion carried <br />unanimously. <br />Mr. Locher said the fines for misdemeanors raises to $500.00 on August 1, 1977. <br />Mr. McLean asked if there had been any further contact with Steve Butts, Mr. Nadeau's <br />Attorney and Mr. Locher said, No. <br />Mr. Zelinka said there is a subject he would like to see some discussion on - the matter <br />of secrecy for juvenile offenders should not be allowed. He felt this City should write <br />to the County Attorney and all Legislators stating this opinion. Mr. Zelinka felt if the <br />names were public it might deter some of the offenses taking place at this time. Mr. <br />Zelinka said he would ask for more discussion on this matter from the Police Chief and <br />the Attorney. Mr. Zelinka moved to put this on the next agenda. Seconded by Mr. McLean. <br />Motion carried unanimously. <br />Mr. Marlin Hansen, developing the Otter Lakes Estates, asked if Mr. Gotwald had delivered <br />the plat to the offices and the Clerk said, No. Mr. Hansen said he would be bringing it <br />in. The answeres from the DNR and the Corps of Engineers had been received. Mr. Hansen <br />said they would like to know the amount of money that will be due in lieu of land for park <br />purposes. This is needed in order to know the expenses for that development. <br />Mr. McLean said this figure would be 10% of the market value of the land at the time of <br />platting. He felt this figure should be supplied by the Assessor and negotiated by the <br />Council with the property owner. Mr. McLean felt the time and expenses for the Assessor <br />should be presented for payment by the owner of the land. Mr. McLean asked these figures <br />be ready for the next Council meeting with Mr. Kelling authorized to contact whomever he <br />felt necessary in order to compile the figures. (Mr. McLean asked the Clerk to check this <br />plat file for the Anoka County Surveyor's check list.) <br />
