It is not right that the worst land should be left for industry. He felt that some landscaping should be done to enhance the Rehbein bus barn on Hodgson Road. Mr. Van Housen stressed once again that the Village should give consideration to bringing in sewer and water. However, developers must pay their share. He then suggested thatthe Council get some ideas to give to the P&Z regarding goals, population, etc. There was further discussion of the Uniform Building Code. Mr. Van Housen suggested 'rather that we look into the St. Paul Building Codes as they are quite strict. Even ours is preferable to parts of the Uniform Code. He again suggested that we take a good look at his proposals, that they would be something for the Attorney to hang his hat on. Mr. McLean commented that often prior notice of hearings, etc., were read in the paper. He felt they should have time to study these things before the meeting. The Clerk was instructed to send copies of the proposals to the P&Z members. They were placed on the agenda for Oct. 27th. Mr. Van Housen especially wished that items one and two be considered. Mr. McLean stated that the P&Z would study the Uniform Building Code next time and asked that Mr. Van Housen be present. He will try. The Clerk was instructed to get copies of the St. Paul Code. The meeting ended about 10:00 p.m. Minutes approved at the meeting of October 13, 1969 2. -, < /Clerk-Treasurer The regular meeting of the Lino Lakes Village Council held on October 13, 1969 was called to order at 8:13 p.m. by Acting Mayor Bohjanen. Also present were W. Jaworski and Mr. Cardinal; absent were Mr. L'Allier and Mr. Rosengren, both out of state. The minutes of the September 22 meeting were amended by adding "Mr. Cardinal moved to adopt Ordinance No. 50 dealing with the raising of the penalties on the ordinances. Seconded by Mr. Jaworski. Carried." Corrections to the September 22nd minutes were made and Mr. Jaworski moved to accept these minutes as corrected and amended. Seconded by Mr. Cardinal. Carried. Mr. Cardinal moved to accept the minutes of the September 25th budget meeting as written. Seconded by Mr. Jaworski. Carried. Mr. Jaworski moved to table the minutes of the special September 29th meeting with Springsted Inc. on Mr. Bohjanen's suggestion (since he had not been present at same). Seconded by Mr. Cardinal. Carried. A report on plastic pipe made by Mr. West, Plumbing Inspector, was read as follows: The 1969 State Plumbing Code approved of the use of plastic pipe with the fol- lowing restrictions: 1) the maximum length (either horizontal or vertical) is 30', 2) it cannot be laid underground, 3) it cannot be encased in concrete or in masonry walls, 4) if it is to be used for hot water it must be hung on solid hangers, 5) the gauge must be #40 or better. Mr. West stated that the new code books would be out prior to October 15 and that the code would not be in effect until that time. The Village will receive a free copy of the code by that date. The Department of Health people suggest that the Village investigate the plastic pipe thoroughly before adopting its use. The State Code is a minimum code we don't have to approve of it or any parts of it which we don't like. Mr. Cardinal mentioned that the Planning and Zoning Commission didn't think much of the pipe. Mr. Jaworski moved, on Mr. Bohjanen's suggestion, that the report be turned over to the P&Z for one meeting's study and that they report back to the Council at the. next opportunity. Seconded by;°Mr. Cardinal. Carried. A letter from Mr. Locher regarding Mr. LaMotte's plat and the filing of the deed for the outlot, which Mr. Locher felt that he should do at the Village's expense, was read. The Clerk noted that Mr. Jack DeVine, who had appeared before the Council on May 26th to answer questions on his trailer parked on Ash Street, had never asked for a trailer permit or a special use permit. Mr. Cardinal moved that Mr. Locher send a letter to Mr. DeVine for action. Seconded by Mr. Jaworski. Carried. A lengthy fire report from the Lexington Fire Department was read, as was a copy of a letter from Mr. Jake Lundheim to Mayor L'Allier on the County signing of roads. Several other notices, etc. were passed around for perusal. The suggested wording of the letter to be sent to registered voters regarding the bond election was read. -After considerable discussion and a breakdown of costs by Mr. Gotwald, Mr. Bohjanen moved that the suggested wording be used but with the addition of "garage" with shop, and that a sentence spelling out the fact that the $100,000 would not only be for the building alone, but would defray the costs of attorney's fees, architectural fees, bonding counsel fees, Springsted's fees along with miscellaneous equipment and site improvement. Seconded by Mr. Cardinal. Carried unanimously. It was also noted that a contractor doesn't have these additional fees and therefore their costs are lower. A copy of the North Oaks building code, just received, was given to Mr. Cardinal for consideration by the Planning Board. Only one bid had been received on the police car, that of Fairview Chrysler- Pluth,;. Inc. The amount bid was $2873.00. Mr. Locher noted that under the new contracting statutes, it was necessary to have at least two bids. Since there was a letter accompanying the bid which listed some variation of the specifications, it was decided that the police should look over the bid and that the Clerk should try to get another bid on the car. Mr. Cardinal moved to table the matter until next time. Seconded by Mr. Bohjanen. Carried. Two character references on Mr. Wm. Horbal, new owner of the Oasis, were read: one from Sheriff Talbot and one from Kingsley D. Holman, Attorney. The Clerk was instructed to place these on file until Mr. Horbal applies for the licenses. Mr. Cardinal reported that he had a request from Mr. Verner Dahl for a special use permit for his trailer house on the Marlin Rygh farm on 35E and the service road. Also, Mr. Joseph Schmitz in the audience, asked for a special use permit to park a trailer at 6309 Hodgson Road. 1 1 1 1 1 After discussion by the Council and the Attorney, Mr. Cardinal moved to set the dates of December 17th before the P&Z and December 22nd before the Council for hearings for Mr. Dahl at 8:30 and Mr. Schmitz at 9:00 p.m. Seconded by Mr. Jaworski. Carried. Mr. Bohjanen asked Mr. Cardinal about the legal for Twitchell cemetery. Nothing has yet been received. Mr. Cardinal mentioned that the hearing on the trailer court off Elm Street was to be Wednesday night. He then brought up the subject of the planned meeting with the Yin. Waldochs on the purchase of the 30 acres. Mr. Cardinal moved that the Council authorize Mr. Cardinal and Mr. Locher to carry out the previous commitment to enter into a contract for deed on the 30 acres for a period of five years, at the interest rate of 5 %, that the Mayor and Clerk be authorized to sign the proper forms, and that they authorize the purchase of a new abstract on the entire parcel at an estimated cost of $100.00. Seconded by Mr. Jaworski. Carried. Mr. Cecil LaMotte presented the deed for Outlot 1 of LaMotte's Second Addition to the Council and stated that the plat had been filed. The Clerk noted that the re- quested correction on the final plat had been inadvertently left out, but that she and the Mayor had signed it anyway. Mr. Cardinal moved that Lino Lakes adopt a resolution accepting the deed to Outlot 1 and that the Attorney be authorized to file same. The Council will attach the stamps in the amount of $2.20. Seconded by Mr. Jaworski. Carried. Mr. LaMotte noted that he was getting the opinion on the Husnik lot and that an abstract was being made on the same. Mr. LaMotte also presented a check in full payment of all fees on the platting. Mr. Jaworski reported that he had met with the Engineer and the Park Board concerning the possibility of a park on Otter Lake. There is a proposal that Anoka and Ramsey Counties plan for a park in that area. Mr. Gotwald stated that this would probably be the entire area between Otter Lake and Bald Eagle Lake and was approved by Ramsey County. After discussion Mr. Gotwald agreed to contact Mr. Roy Nadeau of Ramsey County Park Board to set up a possible meeting with our Park Board to discuss this on November 17th. Mr. Gotwald will also attend the meeting. Mr. Kordiak will also be invited. Mr. Jaworski inquired of Mr. Locher whether one of the police could sign a complaint against a violator of an ordinance when no individual person would sign one. Mr. Locher answered that a complaint needed to be signed if the matter was to be taken to court and that either the police or the building inspector can sign these. Mr. Jaworski also recommended that one of our signs against shooting of firearms be put up by Otter Lake Road on the County line and that a dead end sign be put up on Harold Hansen's road. Mr. Backlin will take care of this. Mr. Fran Burque complained that shooters had damaged his machine last weekend and that the police had been told. He also requested an elevation on a culvert to be placed on 64th; he was told to ask Mr. Backlin for this. A man in the audience complained about the speed by the Lino School. The Clerk was instructed on a motion by Mr. Cardinal, seconded by Mr. Jaworski, carrying unanimously to write the State on changing the sign from "Randeau" to "Rondeau Lake Road.E. ", and to write the County on setting a 30 mph speed limit by the Lino School. 10 BE IT RESOLVED by the Village Council of the Village of Lino Lakes, Minnesota as follows: 1. The Village Council has determined that it is necessary and expedient to construct a building for Village Hall, garage and other municipal uses at an estimated cost of $79,000.00 and to provide payment of the cost by issuing general obligation bonds of the Village in an amount not exceeding $100,000. 2. The question of isstipg negotiable coupon bonds to provide money to pay the cost thereof shall be submitted to the voters of the Village at the annual Village election to be held November 4, 1969. 3. The Village Clerk is authorized and directed to cause printed ballots to be prepared for use at said election. The proposition shall be stated in substantially the following form: OFFICIAL BALLOT -- VILLAGE ELECTION -- VILLAGE OF LINO LAKES -- Nov. 4, 1969 Yes t' / SHALL THE VILLAGE OF LINO LAKES ISSUE ITS NEGOTIABLE COUPON BONDS IN No THE AMOUNT OF NOT TO EXCEED $100,000 TO PROVIDE MONEY FOR CONSTRUCTION OF A BUILDING FOR VILLAGE HALL, GARAGE, AND OTHER MUNICIPAL PURPOSES The following police report was read: Mileage 2242, 7 accidents, 1 fire, 21 complaints, 4 domestics, 5 junk cars removed, 6 assists to other departments, 5 vandelism, 2 cars recovered, 1 stolen car, 5 missing persons (not Youth Center), 1 recovered person, 1 Driver's license pickup, and:'2 stolen property. Mr. Jaworski moved that the following resolution be adopted: A RESOLUTION RELATING TO NECESSITY OF ISSUANCE OF BONDS FOR A MUNICIPAL BUILDING AND CALLING AN ELECTION r Instructions to voters: Voters desiring to vote in favor of the foregoing proposition shall make a cross mark (X) in the square opposite the word YES. Voters desiring to vote against the foregoing proposition shall make a cross mark (X) in the square opposite the word NO. 4. The Village Clerk shall cause notice of said bond election to be given by publication in the official newspaper of the Village once each week for at least two consecutive weeks prior to said election, and by posting in at least three public and conspicuous places in the Village at least ten days prior to said election a notice in substantially the following form: NOTICE OF BOND ELECTION NOTICE IS HEREBY GIVEN THAT a special bond election will be held at the time and place of the annual Village election on November 4, 1969, at which a vote will be taken on the following question: SHALL THE VILLAGE OF LINO LAKES ISSUE ITS NEGOTIABLE COUPON BONDS IN THE AMOUNT OF NOT TO EXCEED $100,000 TO PROVIDE MONEY FOR CONSTRUCTION OF A BUILDING FOR VILLAGE HALL, GARAGE AND OTHER MUNICIPAL PURPOSES. The polling place for said election will be in the Village Hall. The polls will be open at 7:00 o'clock a.m. and remain open until 8:00 o'clock p.m. All qualified registered voters of the Village are eligible to vote at said election. June L. Motion seconded by Mr. Cardinal. Carried. 11 Mr. Locher noted that the bond election notices must be posted in three places and that two weeks of published notice were necessary. Kay Olson asked that the wording be changed to "qualified registered voters ". Mr. Locher gave out copies of Sign Ord. No. 51 and offered comments on the same. Representatives from Meyer Sign Company and National Adv. Company offered comments and asked questions also. Mr. Jaworski moved to table the matter and send it to the Planning Board for discussion on November 19 and back to the Council on November 24th. Seconded by Mr. Cardinal. Carried.
