The vote was taken on adopting the new Minnesota Plumbing Code, with the inclusion <br />of the notice that we would enforce whichever ordinance is stricter on specific <br />items; it carried unanimously. <br />Mr. Bohjanen had brought up the subject of Mr. Clyde Rehbein's encroachment of a <br />septic system line on Mrs. Hilda Wollan's property during the above discussion. <br />Mr. Cardinal stated that Mr. Rehbein had promised at the P&Z meeting that the <br />line would be moved. Mr. Bohjanen stated that he had been told by the Wollans <br />that Mr. Rehbein had told them he wouldn't move it. Mr. Locher noted that if it <br />is a tresspass, he could be forced to move it; apparently the Wollans don't wish <br />to spend time and money on a court fight if Village regulations have been violated. <br />It was noted that the Building Inspector had red - tagged the septic system line; <br />the Clerk stated that Mr. Rehbein had not taken out permits to install the line <br />and that the contractor who did the work had no license to do so; also, they had <br />been warned by the Plumbing Inspector to get such permits and license. Mr. Locher <br />stated that this was a direct violation of Ordinance No. 47. <br />Mr. Bohjanen moved that a letter be written tc Clyde Rehbein and Clarence and <br />Hilda Wollan with a copy to the Building Inspector stating that Mr. Rehbein was <br />in violation of Ordinance Nc. 47 on septic system installation and that the <br />Building Inspector is hereby authorized to instruct Mr. Rehbein to remove the <br />septic system line within 1 week. Seconded by Mr. Jaworski. Carried unanimously. <br />Mr. Jaworski moved that a letter be written to the contractor, telling him that <br />since he had taken no notice of our ordinances and violated same, if he should do <br />so again he would not be allowed to do any more work in the Village. Seconded by <br />Mr. L'Allier. Carried unanimously. <br />Mr. Cardinal stated that a request for a variance by Mr. Clyde Rehbein and Mr. <br />Russell Bakken to exchange pieces of property in order to straighten out their <br />property lines had been recommended for approval by the Planning & Zoning. Mr. <br />Locher noted that the legal descriptions were in order and this was okay .if both <br />parties were willing. Mr. Cardinal moved to grant a variance to Clyde Rehbein <br />and Russell Bakken to exchange the following described pieces of property: <br />From Clyde Rehbein to Russell Bakken: <br />That part of the Northeast 1/4 of the Southeast 1/4 of Section 8, Township 31, <br />Range 22, Anoka County, Minnesota described as follows: Commencing at a <br />point where the centerline of U.S. Highway No. 8 intersects the centerline <br />of Carlton Road, so called, which road runs along the North line of the <br />said Northeast 1/4 of Southeast 1/4 Section 8, thence East along the <br />centerline of said Carlton Road, so called, a distance of 143 feet, thence <br />South at right angles to said centerline a distance of 400 feet, thence <br />South 32° 34' west a distance of 180 feet; thence North 88° 44' West a <br />distance of 188.68 feet to the point of beginning of property, herein to be <br />described; <br />thence continuing North 88° 441 West a distance of 149.12 feet to the <br />East line of U.S. Highway No. 8, thence North 32 °, 34' East along the <br />east line of U.S. Highway No. 8 a distance of 40 feet, thence South <br />73° 56' East a distance of 133.73 feet to the point of beginning. <br />From Russell Bakken to Clyde Rehbein: <br />That part of the Northeast 1/4 of the Southeast 1/4 of Section 8, Township <br />31, Range 22, Anoka County, Minnesota, described as follows: Commencing at <br />a point where the centerline of U.S. Highway No. 8 intersects the center- <br />line of Carlton Road, so called, which road runs along the North line of the <br />
