12/28/70 <br />There was discussion on the Citizen of the Year award to be presented at the next <br />meeting; Mr. Rosengren and Mr. Cardinal will handle the matter. <br />The Lee C. Smith rezoning hearing was called to order at 9:02 P.M. Mr. Locher <br />read the affidavit of mailing of notices. No one was present to represent <br />Mr. Smith. Mr. Cardinal noted that neither Smith nor Johnson had been present <br />at the P&Z hearing, but Crystal Elliman had stated that Mr. Smith was having <br />delays in getting his materials together. <br />Mr. Cardinal moved to allow Lee Smith 90 days to complete the rezoning process, as <br />recommended py the P&Z; if. no materials are received by then, the hearing will be <br />terminated, since this is the third or fourth continued hearing. Seconded by Mr. <br />Jaworski. Mr. Van Housen felt that 90 days was too generous since Mr. Smith came <br />under the grandfather clause of Ordinance No. 21C; he felt that this could cause <br />a potential,bind on the Village because of the blanket rezoning. Mr. Cardinal <br />retracted the motion. <br />Mr. Locher commented that a portion of the land within 300 feet of the, highway was <br />already commercial; we don't know how much of the remaining area,is concerned -- <br />apparently Ecoff has backed out. Mr. VanHousen noted t1st Mr. Smith had been in <br />his office with plans which were full of idiosynchrosies. Mr. VanHousen was con- <br />cerned with this particular corner since it is the hub of the Village; he didn't <br />feel that this would be the best use of the land. Also, since the property is <br />in Smith's name, we can't make Gulf Oil toe the mark. <br />Mr. Lecher stated that it would be better with limited parcels. There was discussion <br />on the access to the property. After further discussion, Mr. Cardinal changed the <br />motion to allow Lee C. Smith 30 days in which to complete plans for the partial <br />III <br />. rezoning as previously requested on the advice of Mr. VanHousen and Mr. Locher. <br />Seconded by Mr. Jaworski. Carried unanimously. <br />After further discussion, Mi. Jaworski moved to set rezoning hearingsfor Lee C. <br />Smith before the P&Z on January 20th at 9 P.M. and before the Council in January <br />25th at 9 P.M., with the stipulation that all required plans be submitted to the <br />Clerk by the 8th of January; otherwise, the continuation terminates on January 28, <br />1971. Seconded by Mr. Cardinal. Carried unanimously. This motion supersedes and - <br />incorporates the previous motion. <br />Mr. Cardinal moved to close the hearing at 9:20 P.M. Seconded by Mr. Rosengren. <br />Carried unanimously. <br />Mr. Van Housen presented comments on the booklet on zoning classifications which is <br />a first stage of a comprehensive plan. He read through several sections of the <br />lengthkyplan. Mr. Van Housen noted that he had talked with the Metro Parks people; <br />they would like to meet with the Council later in. January. He stated that this <br />classification would fit right into the comprehensive plan. He would like to have <br />the Attorney go through the classification to put in legal terminology, and then have <br />it resubmitted to the P&Z. He noted that the P&Z chairman was a good man who would <br />pull this thing together. <br />Mr. L'Allier stated his appreciation for Mr. Vanes usen's efforts, noting that normally <br />small municipalities have a fear of planners and their fees. He wished Mr. VanHouse <br />to set a tentative date with the Metro Parks people for a special meeting. <br />1 <br />
