1. Establish a center line for the road and take 33 feet either <br />side as a right -of -way. <br />2. Condemnation proceedings. <br />3. Purchase 1 rod of land from Mr. Thies for $300.00. <br />Mrs. Marier, adjacent land -owner to the north stated her desire to have <br />the road repaired and willingness to donate the necessary right -of -way <br />providing the road be relocated farther to the south. L'Allier moved, with <br />second by Ross, to have Gotwald survey from Mr. Thies' north property line <br />to establish the road's centerline and report his findings. In addition, <br />Mr. Backlin may purchase, if necessary, land for rightof -way not to exceed <br />$300.00. Motion carried. <br />Mr. Locher advised that since ownership is not registered in Thies' name, <br />the deed must be signed by former owners and Mr. Thies if the land purchase <br />is made. <br />Gotwald reported that Viking Construction Company, low seal coat bidder, <br />had not posted a performance bond after a 15 to 20 day wait. Gotwald ltd <br />notified the company the contract was null and void. Mr. Backlin motioned, <br />second by Ross, to award the work to the next lowest bidder, Schifsky Con- <br />struction. Motion carried. <br />Gotwald and Backlin had checked the request made by Mr. Ficocello for removal <br />of a culvert at 7942 - 4th Avenue, and advised securing a signed statement <br />releasing the village from any resulting responsibility. Mr. Ross motioned <br />to this effect. No action was taken. Mr. Locher suggested the Council <br />establish an ordinance regulating the purchase of culverts. <br />Peter Scherer stated the county roads in the eastern part of the village <br />used as detours during highway construction were in bad condition. The <br />White Bear School bus will not use 64th Street to the north unless the road <br />is repaired. Backlin will contact the County Engineer's office in regards <br />to repairs and ask the White Bear School District to send a letter to the <br />County registering their complaints. <br />Glenn Rehbein presented a plat of land abutting Highway 8. The land is <br />7 acre short of legal requirements and Mr. Rehbein requested Council's <br />consent to a variance of Ordinance 21A. Ross motioned to permit the request <br />with a resolution drawn up by Locher. Second by L'Allier, motion carried. <br />Rehbein will send a copy of the resolution to the County. <br />Planning Meeting minutes of August 22 were read. A discussion was held on <br />the proposedland fill operations to be located on 38 acres at County Road <br />14, west of 4th Avenue. <br />Ross reported the streets in the Baldwin Lake Motor Court were still in bad <br />condition. Locher will contact the attorney for the Huntley's, owners of <br />the location. <br />L'Allier stated Centerville had requested our village join with them in <br />efforts to oppose a variance for the discharging of sewage into Howard <br />Lake by Forest Lake Village. A resolution to this effect,'signed by the <br />village officials had been presented to Forest Lake. A copy of the reso- <br />lution was read and placed on file. <br />L'Allier reported he had looked at possible future park property owned by <br />Mr. Miller constituting 72 acres on 7th Avenue. Mr. Miller will sell the <br />complete location at $550 per acre. Mr. LaCasse will check on the valuation <br />of the land with L'Allier. <br />
