w L <br />COUNCIL WORK SESSION MAY 6, 1992 <br />Second Addition consists of nine (9) lots. Before the <br />preliminary plat is brought before the City Council, the <br />developer's letter of credit and development agreement will be <br />finalized. Mr. Schneider noted that he did talk to the <br />developer's attorney. The attorney is not aware of what the <br />developer has in mind at this paint. <br />Mr. Schumacher explained that staff has had Mr. Vaughan, the <br />developer, in city hall several times because of some problems <br />that have developed. He said that Mr. Vaughan is not an <br />experienced developer but does mean well and is a good person. <br />Staff is impressing on him that he must follow policies and <br />procedures and not change his plat whenever he pleases. Mr. <br />Schumacher felt that staff will work with Mr. Vaughan and this <br />will be a good development. <br />Mr. Schneider explained that this matter is not on the agenda but <br />wanted the City Council to be aware that they will be seeing the <br />Second Addition shortly. <br />Mr. Schneider reviewed the items that he will address on the May <br />11, 1992 Council agenda. He noted that one (1) item to note is <br />the resolution to award bids for controls and telemetry system <br />for the water system. Mr. Schneider and TKDA will not be <br />recommending that the bid be awarded to the low bidder. TKDA is <br />recommending that the low bidder be disqualified because they did <br />not follow bid specifications. The second low bidder will be <br />recommended. Mr. Schneider noted that the control system appears <br />to be better than expected. The system is the most modern <br />available and can be upgraded as wells are added. Mr. Schneider <br />also noted that it may be possible for the staff to made <br />modifications as needed. <br />Mr. Schneider noted that the new water tower is full of water and <br />testing is being completed. <br />Mr. Schneider explained that a meeting was held this morning and <br />the new Zoning Ordinance was discussed. Specifically, the City <br />Attorney suggested a method of adopting the new ordinance without <br />the expensive outline and publication required by the City <br />Charter. This would require a new public hearing, repealing of <br />the entire old Zoning Ordinance and the adoption of the new <br />Zoning Ordinance by adopting the first and second reading of the <br />new ordinance. <br />Mr. Schumacher explained this would give the City Council an <br />option. He noted that publishing 200+ pages of the new ordinance <br />in the legal newspaper would be very expensive.
