1 <br />1 <br />COUNCIL MEETING <br />unanimously. <br />Resolution No. 92 - 121 can be found at the end of these minutes. <br />Final Plat, Black Duck Estates and Black Duck Estates, Second <br />Addition - Black Duck Estates and Black Duck Estates, Second <br />Addition is a replat of portions of Lakes Addition No. 7 and a <br />portion of Lakes Addition No. 2. Black Duck Estates contains 20 <br />lots and Black Duck Estates, Second Addition contains 27 lots. <br />The two subdivisions are being developed by the same developer <br />and constructed under the same contract. <br />SEPTEMBER 14, 1992 <br />These two (2) subdivisions were extensively reviewed by staff and <br />the Planning and Zoning Board. All revisions have been <br />incorporated into the final plats. A 20 foot wide utility <br />easement across Lots 11, 12, 13 and 14 of Block 1, Black Duck <br />Estates, Second Addition must be vacated by the developer after <br />construction of the utilities and streets is complete. The <br />developer will also be required to provide an access easement <br />across 17, Block 1 to accommodate a driveway for the twin home <br />already constructed in the area. These two (2) items should take <br />place after completion of construction. <br />The developer's agreement has been signed and the project is <br />currently under construction. <br />Mayor Reinert asked if the area will be open to all builders. <br />Mr. Marcel Eibensteiner, the developer of these two (2) <br />subdivisions explained that only four (4) builders have signed <br />agreements with him. However, others may be added later. <br />Mr. Schneider explained that there have been a couple of meetings <br />with the neighbors to the north of these subdivisions regarding <br />the maintenance of the area on the north side of the ponds. An <br />agreement has been reached without City involvement. The <br />developer is proposing that a 20 foot wide easement be given to <br />each of the landowners to the north so that they can continue to <br />maintain the area to the ponds. No shrubbery or buildings will <br />be allowed on this easement. <br />Council Member Elliott moved to approve the final plat of Black <br />Duck Estates and Black Duck Estates, Second Addition. Council <br />Member Bergeson seconded the motion. Motion carried unanimously. <br />ENGINEER'S REPORT, DARRELL SCHNEIDER <br />Mr. Schneider explained that items A through L are all items that <br />are declaring costs to be assessed and setting public hearings <br />for six (6) different improvement projects.
