The property owners sign a form, provided by the City, <br />indicating that they have no objections to the extension of <br />utilities to service this site. This form shall be recorded <br />with the County and apply to future owners. <br />The City Zoning Ordinance provides, in Section 4, Subd. 17 Areas <br />Without Sanitary Sewer, (5) All subdivisions in areas without <br />public sanitary sewer shall be designed such that the larger <br />nonsewered lots can be resubdivided to provide smaller sewered <br />lots when sewer becomes available in the future. Homes shall be <br />located on these lots so as to allow for future resubdivisions. <br />The City Comprehensive Plan also provides for areas identified as <br />ER, Expansion Residential, that ".. any land subdivided into one <br />acre lots must be accompanied by a legally binding resubdivision <br />plan one fourth acre minimum lot size. All houses on the one <br />acre lots must be located to allow for easy resubdivision when <br />sewer becomes available.." <br />To accomplish the provisions of the Zoning Ordinance and the <br />Comprehensive Plan, it is recommended that a 10 foot wide <br />drainage and utility easement be placed down the center of the <br />lot to insure compliance with these requirements. This would <br />allow for future subdivision of the parcel into two buildable <br />lots when and if sewer and water is available to serve the site. <br />Council Member Bergeson noted that the applicant had requested <br />that the easement be placed on one side or the other of the lot <br />and asked why this is not feasible. Ms. Wyland explained that <br />the purpose of the easement is to prevent the owner from building <br />a house in the middle of the lot, thus preventing the <br />resubdivision of the lot when utilities are available. <br />Council Member Neal asked if the utility lines would run down the <br />new easement in the center of the lot. Ms. Wyland said no, they <br />would run across the front of the lot. The easement is merely to <br />document the ability for resubdivision. <br />Council Member Neal moved to adopt Resolution No. 14 - 93 <br />removing the existing easements and locate a 10 foot wide <br />drainage and utility easement down the center of the property and <br />require the new lot owner to sign a document indicating they <br />would not object to the extension of utilities when they do <br />become available. The property owner would be required to <br />provide a new certificate of survey and easement document for <br />recording purposes.
