Council Member Kuether seconded the <br />motion. Council Member Bergeson asked how someone would get this <br />data. Ms. Wyland explained the process. <br />Voting on the motion, motion carried unanimously. <br />FIRST READING, Ordinance No. 93 - 07 Amending Section 4, <br />Subdivision 5 of the Zoning Ordinance Relating to Lot <br />Provisions - City staff has determined that the Zoning Code does <br />not specifically prohibit the construction of buildings on lots <br />located on unimproved right-of-way (R -O -W). Construction of <br />buildings on unimproved R -O -W could prove to be a serious <br />detriment to the orderly development of the City. Therefore, the <br />attached ordinance is being proposed to replace the emergency <br />ordinance No 93 - 03 enacted in March 8, 1993. <br />The notice for the public hearing of this ordinance has been <br />published in the legal newspaper. The proposed ordinance was <br />recommended by the Planning and Zoning Board at their April 14, <br />1993 meeting. <br />Council Member Bergeson asked if there were existing homes on <br />unimproved R -O -W? Mr. Schumacher said he thought that there were <br />none. Council Member Kuether asked if the street had to be <br />blacktopped. Ms. Wyland explained that this depends on the <br />location of the property. The City does have some streets that <br />are gravel only, construction would be allowed on approved lots. <br />Council Member Neal moved to adopt the first reading of Ordinance <br />No. 93 - 07 and dispense with the reading. Council Member <br />Bergeson seconded the motion. Motion carried unanimously. <br />SECOND READING, Ordinance No. 93 - 04 Amending the Lino Lakes <br />Zoning Ordinance by Repealing Public and Semi -Public Uses from <br />Various Zoning Districts Within the City - The first reading of <br />this ordinance was at the March 22, 1993 Council meeting. The <br />item was not placed on the April 12, 1993 agenda but is now being <br />presented for its second reading. <br />As additional background information, the Planning and Zoning <br />Board held a public hearing on Wednesday, March 10, 1993 <br />regarding this ordinance. After due consideration the Board <br />recommended that the amendment be accepted by the City Council. <br />This proposed ordinance is designed to repeal public and semi- <br />public uses from various City zoning districts and clarify those <br />allowed in the PSP, Public and Semi -Public districts. <br />PAGE 20 <br />151 <br />
