considered, and that Mr. Hawkins was working on the agreement. <br />ROSS' LIQUOR STORE <br />The council was brought up to date regarding Anoka County's proposal to purchase <br />17 feet of right of way from Mr. Chris Ross. The purpose for this proposal is to <br />remove Mr. Ross from his existing building in order for the county to demolish for <br />safety and right of way issues. Mr. Ross is proposing to move his business into the <br />recently vacated liquor store located in the Tom Thumb building. Mr. Schumacher <br />explained the importance of the timing of the demolition of the building as it relates <br />to our Tax Increment Financing District. The council raised concerns of vandalism and <br />other safety problems if the demolition were put off too long. <br />Mr. Schumacher stated that he would keep the council appraised of this matter in <br />future sessions. <br />ROSS DEPOSITION <br />Mr. Schumacher reminded the council that depositions for the Birch lawsuit were set <br />for 9:00 A.M. on May 21st, 1993. <br />RESHANAU LAKE BOAT ACCESS <br />Mr. Schumacher recapped that at our last meeting, Mr. Hawkins gave his legal opinion <br />that if the homeowners association did not comply with council instructions, we <br />would be forced to take legal action. The council discussed a possible injunction <br />prohibiting use of the launch. <br />Mayor Reinert felt there were two issues here, the first being a legal issue, the second <br />being present and future relations among the neighbors in this area. Mr. Bergeson <br />stated that the mediator at the county is seeking to get the council involved in <br />mediation. Mayor Reinert cautioned against the city getting involved in the actual <br />mediation. Mayor Reinert added that he would be willing to be involved as a neighbor <br />versus a city official. Ms. Elliott felt that perhaps an injunction would bring both sides <br />back to the mediators table. It was the consensus of the council that reason prevail <br />on this issue. Mr. Schumacher stated that pleadings would be prepared in the first <br />part of next week. <br />Ms. Carrie Ostegren of the Reshanau Park Estates Homeowners Association was <br />present to voice her concerns regarding the city's stand on the boat access. <br />ADJOURN <br />The meeting was adjourned at 7:25 P.M. <br />1 <br />1 <br />
