194 <br />COUNCIL MEETING MAY 24, 1993 <br />Carlson. Mr. Hawkins suggested that word "recommendation" in the <br />letter be changed to "authorization". He also noted that the <br />trail easement was dedicated to the City well before Mr. Kuny <br />purchased the lot and his title company should have made him <br />aware of the easement. Mr. Hawkins also noted that the easement <br />is needed to complete a portion of the trail corridor. <br />Council Member Kuether moved to authorize the letter to Mr. Kuny <br />with the correction noted by Mr. Hawkins. Council Member Neal <br />seconded the motion. Motion carried unanimously. <br />NEW BUSINESS <br />Consideration of Transfer of Off -Sale Liquor License, Ross' <br />Liquor Store - Mrs. Anderson explained that on April 12, 1993, <br />the City Council approved the transfer of the off -sale liquor <br />license at the Tom Thumb Store (Lino Lakes Spirits, Douglas and <br />Robin Hughes) to Mr. Gene Moore contingent upon the Hughes <br />presenting to the City Clerk their current off -sale liquor <br />license and their retailer's buyers card and Mr. Moore submitting <br />a lease agreement with the Tom Thumb Store. Mr. Moore was unable <br />to secure a lease agreement with the Tom Thumb Store and Mr. and <br />Mrs. Hughes would not surrender their license. Mr. Moore was <br />unable to follow through and comply with the City Council motion. <br />Mr. Christopher Ross, who operates an off -sale liquor store <br />across the street from the Tom Thumb Store, is in the process of <br />selling a portion of his property to Anoka County for right-of- <br />way purposes. His building is within the right-of-way and the <br />building will be demolished. Mr. Ross will lose his place of <br />business. <br />Mr. Ross has submitted an application to transfer his business to <br />the Tom Thumb Store. He has also submitted a copy of the lease <br />agreement with the Tom Thumb Store and an Asset Purchase <br />Agreement with Norwest Bank for the inventory at Lino Lakes <br />Spirits. A Lino Lakes Police Department investigation has been <br />completed as well as a Bureau of Criminal Apprehension <br />investigation. Each indicated that Mr. Ross is eligible for the <br />license. A certificate of insurance for the new location has <br />also been received. <br />Mr. and Mrs. Hughes have returned their off -sale liquor license <br />to the City Clerk. The dram shop insurance for Lino Lakes <br />Spirits has been canceled thereby effectively canceling the <br />Hughes license according to the terms of the City Code.
