1 <br />1 <br />COUNCIL MEETING MAY 24, 1993 <br />B. Ten (10) foot easements for utility and drainage purposes <br />shall be provided around the perimeter of the lot, and <br />C. An easement shall be provided, if necessary, for utility <br />services to the lot, and <br />D. A certificate of survey be provided prior to recording the <br />minor subdivision. <br />Council Member Kuether seconded the motion. Motion carried <br />unanimously. <br />FIRST READING, Ordinance No. 93 - 08 Planned Unit Development <br />(PUD) Base Zoning Designation - Mr. Brixius explained that the <br />City Council directed that a draft ordinance be prepared which <br />would establish a Planned Unit Development (PUD) zoning district <br />within the City. <br />The zoning application of a PUD functions as a development <br />procedure whereby a mixing of buildings and uses can occur which <br />cannot otherwise be addressed by the base zoning district, or <br />whereby internal site design standard deviations from the <br />Ordinance may be allowed to improve the site design and <br />operation. <br />Mr. Brixius further explained that the City's existing Planned <br />Development Overlay (PDO) District functions solely as an overlay <br />district where only the permitted and conditional uses identified <br />in the base zoning are allowed. Thus, the PDO application does <br />not provide a mechanism for a mixture of uses upon a single lot <br />of record. Mr. Brixius outlined the proposed ordinance <br />amendment. <br />Mayor Reinert asked if the use provided by the PDO is <br />discontinued would that PDO function disappear when the current <br />owner sells the land? Mr. Brixius explained that the use granted <br />by a Conditional Use Permit remains with the property regardless <br />of who owns the property, but any amendment to the permit or <br />change in the use or design of the property would have to go <br />through a PUD amendment whether its a conditional use within the <br />district or a PUD zoning district. Mayor Reinert said that it <br />was his understanding that a PUD would "tighten" the process and <br />only the designed identified and approved is allowed, any change <br />in the use must go through the entire process. <br />Council Member Neal moved to approve the first reading of <br />Ordinance No. 93 - 08 and dispense with the reading. Council <br />Member Kuether seconded the motion. Motion carried unanimously. <br />PAGE 8 <br />189 <br />
