1 <br />1 <br />1 <br />163 <br />COUNCIL MEETING SEPTEMBER 27, 1993 <br />accessory garage built on his lot and now he would like to <br />subdivide his lot and sell off the back portion. However, the <br />accessory garage was constructed in a position that will not <br />allow for the subdivision. She asked that the placement of <br />accessory buildings be referenced in this proposed ordinance. <br />Mr. Brixius said he would add this provision on the first page <br />under (5) Setbacks for Accessory Buildings. This language will <br />be included in the ordinance for the second reading. <br />Mr. Schumacher asked for clarification regarding the Conditional <br />Use Permit. Ms. Wyland explained that the Conditional Use Permit <br />would be used if a resident wanted a building larger than the <br />maximum size provided for in their district. Mr. Schumacher said <br />he would like the City Council to be aware of this provision <br />because it has been a problem in the past. Mr. Brixius explained <br />that the Conditional Use provision was added to the ordinance to <br />avoid the need for a variance but would have to meet certain <br />criteria. Variances can only be approved if a hardship is <br />established. In any case, adjoining neighbors would be notified <br />by mail of the request. Mr. Schumacher noted that this provision <br />has been a problem in the past and opens the door for requests <br />for additional square footage. <br />Council Member Bergeson noted that the Zoning Code requires <br />specific amounts of green space on each lot. He asked if there <br />are any provisions in this proposed ordinance that could <br />potentially violate that section of the Zoning Code. Mr. Brixius <br />explained in considering any request, the Planning and Zoning <br />Board should always adhere to the stricter provision. In doing <br />so, no provision of the Zoning Code would be violated. Council <br />Member Bergeson noted that there are several provisions <br />addressing houseboats. He suggested that since houseboats have <br />never been used in Lino Lakes this provision be stricken from the <br />ordinance. <br />Council Member Kuether <br />Ordinance No. 93 - 17, <br />Council Member Elliott <br />A lady in the audience <br />proposed ordinance and <br />moved to adopt the first reading of <br />Accessory Buildings and Structures. <br />seconded the motion. <br />told the City Council that she favors the <br />encouraged the City council to pass it. <br />Voting on the motion, motion carried unanimously. <br />FIRST READING, Ordinance No. 93 - 18, Amending Appendix B1, Areas <br />Without Sanitary Sewer - Mr. Brixius explained that the current <br />Zoning Ordinance address sanitary sewer and allows for <br />subdivisions that are below the 10 acre minimum for rural <br />districts.
