334 <br />COUNCIL WORK SESSION DECEMBER 8, 1993 <br />explained that the Capital Improvement Program portion of the <br />Surface Water Management Program recommends that the City update <br />the Federal Emergency Management Agency (FEMA) study and maps. <br />Mr. Keehn noted that water quality goals will be approached from <br />a regional standpoint rather than a local prospective. The <br />citizens task force will be established to set standards for <br />water quality. <br />Mr. Keehn explained that it has always been the intent that the <br />City will permanently take over the permitting authority as well <br />as records management and documentation. <br />Mr. Schneider noted that he had received a letter from the Rice <br />Creek Watershed District (RCWD) to the Board of Water and Soil <br />Resources (BWSR) indicating that they have elected to act as the <br />Local Government Unit (LGU) for the entire District beginning <br />January 1, 1994. However, BWSR is encouraging municipalities to <br />become their own LGU and declare that the municipality will <br />follow all wetland regulations. <br />Mr. Keehn told the City Council that a resolution is being <br />prepared to be presented to the City Council on Monday adopting <br />the permanent rules of the Wetland Conservation Act. <br />Mr. Keehn suggested that after the City declares itself as the <br />LGU, they may consider selecting several different firms who are <br />qualified to actually prepare wetland delineations. Council <br />Member Bergeson asked if RCWD is in favor or opposed to the <br />municipalities becoming their own LGU. Mr. Schneider said that <br />indications are the RCWD wants to continue to be the LGU. He <br />will be meeting with RCWD to go over the entire plan and talk <br />about implementation details. <br />Mayor Reinert asked if the preparation of the Surface Water <br />Management Plan was on schedule. Mr. Keehn said yes and <br />explained the progress of certain items in the Plan. <br />Mr. Schneider explained that timing is becoming important in <br />regard to ditch maintenance. State statutes read that if a ditch <br />has not been maintained by the RCWD within the past 20 years, the <br />land reverts to wetland. It appears that nothing has been done <br />by the RCWD with the ditches in Lino Lakes and the opportunity to <br />call RCWD to maintain the ditches is quickly diminishing. <br />Recently the City entered into a joint agreement to study the <br />ditches in the 4th Avenue area and we have verbal agreement from <br />RCWD for help in rectifying some ptoblems in this area.
