4') <br />CITY COUNCIL MEETING FEBRUARY 14, 1994 <br />Ordinance 02 - 94 rezoning a portion of property south of Birch <br />Street, West of 12th Avenue and adjacent to Holly Drive from R-1 <br />Residential to R -1X Executive Residential. Although this <br />property is referred to as the LaMotte/Whitcomb property, there <br />are other property owners affected by the proposed change in <br />zoning. <br />The staff and the Planning and Zoning Board recommend approval of <br />the SECOND READING of Ordinance No. 02 - 94. <br />Council Member Neal asked if all the information requested by <br />some residents in the area was given to them. Ms. Wyland <br />explained that some residents were in the office and were given a <br />summary of all the information available. Council Member Kuether <br />moved to approve the SECOND READING of Ordinance No. 02 - 94. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously. <br />Ordinance No. 02 - 94 can be found at the end of these minutes. <br />SECOND READING, Ordinance No. 01 - 94, Rezone Pheasant Hills <br />Preserve, Fifth Addition - Ms. Wyland explained that the City <br />Council approved the FIRST READING of this ordinance and a <br />preliminary plat plan for this subdivision at the January 24, <br />1994 City Council meeting. The proposed rezone would change the <br />zoning on a specific parcel from PSP, Public, Semi -Public to R -1X <br />Executive Residential. The staff and the Planning and Zoning <br />Board recommended approval of the rezone request. <br />Council Member Kuether moved to adopt the SECOND READING of <br />Ordinance No. 01 - 94 as presented. Council Member Elliott <br />seconded the motion. Motion carried unanimously. <br />Ordinance No. 01 - 94 can be found at the end of these minutes. <br />ENGINEER'S REPORT <br />Consideration of Resolution No. 94 - 05 Re -Aligning Park Trail, <br />Shores of Harshen Lake - Mr. Schneider used the overhead <br />projector and showed the platted location of the proposed trail <br />and the proposed re -alignment of the trail. The re -alignment <br />change is being proposed by the developer, Jack Menkveld. The <br />proposed change would move the trail closer to the lake. This <br />proposal is supported by several residents along the trail. The <br />entire trail will be constructed to City standards using a <br />boardwalk type of trail where fill is not allowed due to the <br />presence of wetlands. The developer will be responsible for <br />obtaining the appropriate easements to accommodate the new <br />alignment and will pay any additional costs generated by the <br />PAGE 6 <br />1 <br />1 <br />
