1 <br />1 <br />CITY COUNCIL MEETING FEBRUARY 14, 1994 <br />change. After the trail construction is complete on the new <br />alignment, the original trail easements on Lots 4 through 12, <br />Block 5 will be vacated. <br />Mr. Schneider noted that not all homeowners in this block are <br />entirely satisfied. The owners of Lot 12 (the Sternke's) want <br />the trail walkway placed further away from their home and closer <br />to the lake and also they do not want the trail placed on the lot <br />line between Lots 12 and 13 as platted. Mr. Schneider suggested <br />that the trail easement could be located on the north lot line of <br />Lot 14 since this lot is not yet sold. <br />Mrs. Sternke and Mrs. Houchins (owner of Lot 13) said that the <br />proposed walkway was too close to their homes and they want the <br />walkway relocated closer to the lake. Mayor Reinert asked why <br />the walkway could not be placed at a different angle as shown by <br />the "blue line". Mr. Menkveld explained that this change would <br />create extra boardwalks which are costly to install and costly <br />for the City to maintain. Mr. Menkveld noted that the owners of <br />both Lots 12 and 13 purchased their lots with the full knowledge <br />that a trail or walkway was to be placed as shown on the original <br />map. Mr. Menkveld explained that the walkway can be constructed <br />as originally planned, however, there would be less impact to the <br />homeowners if the trail was re -aligned as now proposed. <br />Council Member Kuether asked where the south end of the walkway <br />ends. Mr. Menkveld said that it will connect to a similar <br />walkway along the lake on the adjoining parcel when it is <br />developed. Council Member Kuether asked if the walkway on Lots <br />12 and 13 can be placed further to the east and closer to the <br />lake. Mr. Menkveld said yes, however, boardwalk would be <br />required instead of asphalt. Council Member Neal asked if the <br />owner of Lot 11 (Todd Nadeau) was aware of the proposed trailway. <br />Mr. Nadeau explained he had purchased his lot from his builder <br />and was told that the walkway would be placed about where the <br />silt fence was currently placed. This information was not <br />correct and the walkway will be much closer to his house. <br />Mayor Reinert noted that the walkway has become a problem for the <br />City Council to deal with because there was not full disclosure <br />when individual lots were sold to home buyers. <br />Mr. Schneider explained that he has brought this matter before <br />the City Council this evening in an effort to keep the City <br />Council out of the negotiation process. The resolution is <br />appropriate in that the residents can be assured that once they <br />have negotiated a re -alignment of the walkway with the developer, <br />the City will vacate the existing easement.
