(c) The proposed use conforms with all performance standards contained herein. <br />(d) The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />(e) Traffic generation by the proposed use is within capabilities of streets serving the <br />property. <br />(6) A public hearing on the rezoning application shall be held by the Planning and Zoning <br />Board or City Council. <br />(7) The City Council must approve or deny the application for zoning amendment request <br />within sixty (60) days of receiving all required information. The sixty (60) day time limit starts <br />over only if the City sends notice, within ten (10) business days, of receipt of the request, telling <br />the applicant what information is missing. The City may extend the sixty (60) day time limit <br />before the end of such time limit by providing written notice of the extension to the applicant. <br />The notification shall state the reasons for the extension and its anticipated length, which may <br />not exceed sixty (60) days, unless approved by the applicant. Failure of the City Council to deny <br />an application within sixty (60) days is approval of the request. If the City Council denies a <br />request, it shall state in writing the reasons for the denial at the time it denies the request. <br />(8) Approval of a proposed amendment shall require passage by a majority vote of all <br />members of the City Council except that the adoption or amendment of any portion of a zoning <br />ordinance which changes all or part of the existing classification of a zoning district from <br />residential to either commercial or industrial requires a four-fifths (4/5) majority vote of all <br />members of the City Council. <br />(9) The amendment shall not become effective until such time as the City Council approves <br />an ordinance reflecting said amendment and after said ordinance is published in the official <br />newspaper. An emergency ordinance shall take effect immediately upon its adoption or at such <br />later date as it specifies. Every other ordinance shall take effect thirty (30) days after its <br />publication or at such later date as it specifies. <br />(10) No application for a zoning amendment or rezoning which has been denied shall be <br />resubmitted for a period of twelve (12) months from the date of said order of denial. <br />2-2 <br />
