§ 1007.016 ADMINISTRATION: CONDITIONAL USE PERMITS. <br />(1) General Statement. Certain uses, while generally not suitable in a particular zoning <br />district, may under some circumstances be suitable. When such circumstances exist, a <br />conditional use permit may be granted. Conditions may be applied to issuance of the permit and <br />an annual review of the permit shall be required. The permit shall be granted for a particular use <br />and not for a particular person or firm. Conditional use permits may be granted in accordance <br />with this subdivision for any use or purpose for which such permits are required or permitted by <br />this ordinance or as listed as a conditional use for the zoning districts provided in § 1007.080 <br />through §1007.132 of this ordinance. <br />(2) Procedure. <br />(a) The person applying for a conditional use permit shall fill out and submit to the <br />Zoning Administrator a "Land Use Application Form" together with a fee as established by City <br />Council resolution. The request for conditional use permit shall be placed on the agenda of the <br />Planning & Zoning Board according to the City's deadline and meeting schedule. The request <br />shall be considered officially submitted and the application approval time line commences when <br />all the information requirements are complied with. <br />(b) A public hearing on the conditional use permits shall be held by the Planning and <br />Zoning Board or the City Council. <br />(c) At least ten (10) days prior to the public hearing; notice of the purpose, time and <br />place of such public hearing shall be published in the official newspaper of the City and mailed <br />to the property owners within three hundred fifty (350) feet of the property in question. Failure <br />of any property owner to receive the mailed notification shall not invalidate the proceedings. <br />(d) The applicant or his representative must appear before the Planning and Zoning <br />Board in order to answer questions concerning the proposed conditional use. <br />(e) Site and building plans consistent with the requirements established in § 1007.019 <br />(2) shall be provided prior to Planning and Zoning Board review. <br />(f) The Zoning Administrator shall instruct the appropriate staff persons to prepare <br />technical reports where appropriate and provide general assistance in preparing a <br />recommendation of the action to the City Council. <br />(g) Standards. The Planning and Zoning Board shall recommend a conditional use <br />permit and the Council shall order the issuance of such permit only if it finds the following <br />criteria have been met: <br />1. The proposed development application has been found to be consistent with the <br />policies and recommendations of the Lino Lakes Comprehensive Plan including: <br />a.
