1 <br />1 <br />1 <br />15 <br />CITY COUNCIL MEETING AUGUST 8, 1994 <br />matter started in 1987 when a Comprehensive Land Use Plan <br />amendment was considered. There is about a two (2) year time <br />frame from when the proceeding were started and final action <br />occurred. He gave the background on this matter. <br />Council Member Elliott asked Mr. Brixius to read the second <br />paragraph of page four (4) of the May 4, 1994 report, General <br />Development Concept". Mr. Brixius read the paragraph. The <br />paragraph deals with density. <br />Mayor Reinert asked in the regular R -1X concept plat are there <br />less cul-de-sac maintenance issues than in the PDO concept plat? <br />Mr. Brixius used the overhead project showing the original May 4, <br />1994 plat submission and outlined the cul-de-sacs. The PDO <br />retained the longer cul-de-sacs and eliminated the "bubble" in <br />each cul-de-sac. <br />Mr. Lyden said he had an overhead that concerns the cul-de-sacs <br />and asked to present it at this time. He noted that the <br />acceptable standard is about four (4) cul-de-sacs per 120 houses. <br />He said that when a request for exceeding the standard is <br />submitted, there should be a good reason for the request. This <br />PDO request is 150% above the standard. He also noted that the <br />developer has used this information to reduce the number of cul- <br />de-sacs by platting a road through wetlands. <br />Mr. Corson explained that at the time a purchase agreement was <br />obtained on the property, the City began the process to rezone <br />the property from R-1 to R -1X. He said that the developer <br />supported the rezone with the understanding that some of the <br />density loss could be offset by a PDO. Then as the process <br />continued, it became apparent that the Planning and Zoning Board <br />would not approve a PDO under any circumstances. Mr. Corson <br />specifically requested that the minutes show that if a PDO was <br />never an option, he should have been allowed to pursue it. <br />Mr. Corson presented a new preliminary plat based on staff <br />recommendations. The new plat shows 115 lots and each lot that <br />is deficient is marked. He outlined all areas that do not meet <br />R -1X standards. Mr. Corson said that this is the first time he <br />has heard the requirement for the developer to pay for the <br />reconstruction of Holly Drive and 12th Avenue from Birch Street <br />to Country Road J (Ash Street). He was aware of the requirement <br />to reconstruct Holly Drive from the subdivision north to Birch <br />Street. Mr. Corson asked if there will be other development <br />along Holly Drive that would generate additional traffic and <br />impact Holly Drive. <br />Mayor Reinert again referred to the Planning and Zoning Board <br />PAGE 15 <br />
