115 <br />CITY COUNCIL MEETING AUGUST 8, 1994 <br />minutes and said that it appeared that the developer was being <br />told to prepare a R -1X plat and the developer felt that this was <br />not acceptable. Mr. Corson said that there was confusion because <br />the developer had brought a letter to the City Council requesting <br />that a PDO be considered and felt that there was favorable <br />response from the City Council. The matter was referred back to <br />the Planning and Zoning Board. Mr. Corson said that he thought <br />that the Planning and Zoning Board would tell them if they would <br />consider a PDO or tell them to prepare a R -1X plat. It became <br />clear that they would not accept a PDO and did not give the <br />developer an option come back with a R -1X. Mayor Reinert said <br />that originally the Planning and Zoning Board told the developer <br />to go with a R -1X plan. Mr. Corson said that several months were <br />spent pursuing a PDO and did not want to start all over. Mayor <br />Reinert said that the developer was given direction all the way <br />through that the Planning and Zoning Board would accept a R -1X <br />concept. He also said that he favored a PDO because the City <br />would have more control over the development. Mr. Corson said <br />that going back to the Planning and Zoning Board with a R -1X <br />would be acceptable, however, he was given the understanding that <br />the entire process would be required including a public hearing. <br />Mr. Brixius said that at this time there is one application for a <br />PDO. Until that application has received final action by the <br />City Council, the application remains open. However, if the <br />developer decides to proceed with the R -1X plat, a new <br />application and a new public hearing would be required. <br />Council Member Bergeson said that the developer has indicated <br />that the Holly Drive reconstruction requirement is new <br />information and asked if the developer wanted a decision on the <br />PDO tonight or if more time is needed before a decision is made. <br />Mr. Corson said that this is a surprise and needs more <br />discussion. Council Member Bergeson said that he wanted <br />everybody to understand all of the options. <br />Council Member Kuether asked where this road requirement came <br />from? Mr. Schneider explained that the reconstruction of Holly <br />Drive has been discussed for some time. After the last <br />discussion of the plat, the developers attorney sent a letter <br />objecting to any participation in the upgrading of Holly Drive. <br />This is a state aid designated road and there has been some <br />discussion regarding modifying state aid standards to allow the <br />road to be constructed less expensively and yet function just as <br />well. State aid funds will be used to fund a portion of the <br />reconstruction. In addition other development such as the <br />proposed City regional park would also contribute to the costs. <br />Nothing has been worked out and part of the problem is that the <br />developer has not been able to determine how many lots he will be <br />able to plat.
