4% <br />COUNCIL MEETING AUGUST 22, 1994 <br />Council Member Kuether asked if the property was located in the <br />MUSA area. Ms. Wyland said no. Council Member Kuether asked if <br />a ghost plat would be required when an application for a building <br />permit for the -new house was requested. Ms. Wyland explained <br />that the City Code did require that a ghost plat be submitted <br />with the building permit. <br />Council Member Kuether moved to approve the minor subdivision for <br />Ida Houle. Council Member Neal seconded the motion. Motion <br />carried unanimously. <br />Consideration of a Conditional Use Permit for Westlund, Bodeka, <br />Hoppe, Forsham Lake Drive for Reduction of Berm - Three (3) <br />property owners on the north side of Forsham Lake Drive are <br />requesting that the berm along their rear property line be <br />reduced. Initially the berm was installed as part of the Shores <br />of Marshan development and contains some buried debris from the <br />former Forjay operation. Disclosure of this buried debris was <br />provided to the property owners at the time of purchase. The <br />request is to reduce the size of the berm by approximately two <br />(2) feet which will enhance the useability of the applicants rear <br />yards. <br />The property is zoned R-1, Single Family Residential and a public <br />hearing was conducted at the August 10, 1994 Planning and Zoning <br />Board meeting after property notification and publication. <br />Engineering consultant John Powell has reviewed the request as it <br />relates to the overall grading of the plat and the specific <br />properties to be regraded. The three (3) lots immediately west <br />of the subject lots are currently owned by the developer of the <br />Shores of Marshan. He has been contacted regarding any interest <br />in participating in the moving of the berm but indicated no <br />interest at this time. <br />The staff recommends approval of the Conditional Use Permit <br />subject to the following conditions: <br />1. Grading activity must leave sufficient topsoil cover over <br />the buried debris to support turf establishment. <br />2. Grading activity is to be contained to that area lying south <br />of the north property lines of the affected lots and <br />matching the existing grade two (2) feet from the property <br />line as indicated on the drawing. <br />3. Existing drainage routes must be maintained. Sufficient <br />berming must remain such that drainage from the church site <br />is not directed to the south and into the backyards of these <br />lots. <br />PAGE 13 <br />
