46 <br />COUNCIL MEETING AUGUST 22, 1994 <br />4. Erosion control, consisting of silt fencing, hay bales, etc. <br />will be required until turf is established. <br />5. Regrading must be gradually blended into the undisturbed <br />berms lying east and west of the proposed regrading area. <br />6. Existing trees be replaced on the berm. <br />The Planning and Zoning Board reviewed this request and <br />recommended approval of the Conditional Use Permit with the <br />conditions outlined by the staff. <br />Council Member Kuether asked who would make sure that the <br />existing drainage is maintained. Ms. Wyland said that the City <br />Engineer would oversee the project. <br />Council Member Elliott moved to approve the Conditional Use <br />Permit subject to the six (6) conditions outlined by staff. <br />Council Member Bergeson seconded the motion. Motion carried <br />unanimously. <br />Consideration of a Conditional Use Permit for Al Robinson, 401 <br />Main Street - Mr. Robinson has requested a Conditional Use Permit <br />to deposit approximately 50,000 cubic yards of "topsoil" 20 to 25 <br />feet in depth to be used as coverage for a five (5) acre area. <br />The material will be stored temporarily (up to three (3) years) <br />and used as top soil for the existing landscaping business both <br />for resale and re -use on the existing sod fields. The material <br />will be coming from the Main Street reconstruction project. The <br />applicant intends to provide hay bales and silt fence as <br />necessary and seed/mulch the slopes. <br />The property is zoned Rural and according to the Zoning <br />Ordinance, reclamation shall be permitted by conditional use <br />permit in all districts. Depositing a total of more than 50 <br />cubic yards of material per acre, either by hauling in or <br />regrading the area, shall constitute land reclamation. <br />Notification has been made in the official newspaper and property <br />owners within 350 feet of the site have been notified by mail. <br />The Planning and Zoning Board held a public hearing on the <br />request August 10, 1994. At this meeting, the Planning and <br />Zoning Board recommended approval of the Conditional Use Permit <br />with the following conditions: <br />1. A wetland delineation of the site be prepared. <br />2. Correspondence from the Rice Creek Watershed District <br />indicating whether or not a permit is required from them. <br />PAGE 14 <br />
