1 <br />1 <br />1 <br />2 3 <br />COUNCIL MEETING NOVEMBER 28, 1994 <br />TO THE OPERATION OF SNOWMOBILES AND ALL -TERRAIN VEHICLES, CHIEF <br />PECCHIA <br />Chief Pecchia explained that he has received general information <br />types of questions since the FIRST READING of the proposed <br />ordinance. The questions related to time of operation and the <br />reason for adopting a snowmobile ordinance. <br />Chief Pecchia noted that several housekeeping changes have been <br />made to the text including changes relating to gender and <br />misspelling corrections. A provision has been added to section <br />11 under Operation Generally which reads: "This provision is not <br />intended to prohibit snowmobiles from entering or leaving the <br />City of Lino Lakes during the above hours, providing that the <br />operator of a snowmobile utilizes the most direct route of travel <br />to and from the operator's residence or destination". Chief <br />Pecchia recommended that the Ordinance No. 17 - 94 be adopted as <br />amended. <br />Council Member Kuether asked if there were any questions relating <br />to the use of lake surfaces. Chief Pecchia explained that lake <br />surfaces are regulated by the Department of Natural Resources <br />(DNR) and Anoka County. <br />Council Member Bergeson asked if the suggested amendments have <br />been reviewed by the City Attorney. Mr. Hawkins said he had <br />reviewed the proposed amendments. <br />Douglas Koppy, 6689 East Shadow Lake Drive explained that the <br />curfew may be too restrictive during holidays. He noted that <br />snowmobiles have only about two and one half months of operation <br />and asked that holidays be treated like weekends. Mayor Reinert <br />asked that the ordinance, as proposed, be tested this winter <br />season and if amendments are needed, Chief Pecchia can bring them <br />to the City Council in the spring. <br />Chief Pecchia explained that he has asked the Rice Creek <br />Snowmobile Club to help get word of the new ordinance to all <br />snowmobilers. He noted that he has received the cooperation of <br />the Club and expressed his appreciation. <br />Council Member Bergeson questioned item No. 8 under Operation <br />Generally. He noted that snowmobiles do break down at unexpected <br />times and at unexpected places and are then towed with a rope or <br />chain to be repaired. Rigid towing devices are not available in <br />these instances. Chief Pecchia explained that an officer will <br />use "reasonableness" when dealing with these instances. The <br />section is referring to towing a child on a sled or some other <br />similar situations. <br />PAGE 5 <br />
