9' <br />COUNCIL MEETING JANUARY 23, 1995 <br />purchase an additional 40 feet of property from the Haegs. <br />The property is zoned Single Family Residential (R-1) and is <br />provided with utilities. The proposed subdivision would add a 40 <br />foot by 90 foot piece of property to the existing lot for a total <br />of 15,930 square feet in area. The new lot would then be 90 feet <br />by 177 feet. <br />Staff has reviewed the request and is recommending approval of <br />the request with the condition that Park Dedication be waived. A <br />Park fee was collected with the original subdivision approval. <br />The Planning and Zoning Board reviewed the request and also <br />recommended approval as submitted. <br />Council Member Elliott moved to approve the minor subdivision <br />request as submitted. Council Member Kuether seconded the <br />motion. Motion carried unanimously. <br />Consideration of a Minor Subdivision, K -G Development, 84 White <br />Pine Road - Ms. Wyland explained that the City Council previously <br />granted preliminary approval to a plat for the Woods of Baldwin <br />Lake, Second Addition in October, 1994. Since that time, Mr. <br />Goertz, the developer, has sold an existing home on the property <br />and would like to close on the sale prior to approval of the <br />final plat. To facilitate this closing, a minor subdivision is <br />necessary to split the existing homesite from the balance of the <br />plat. <br />The property is zoned Single Family Executive (R -1X) and is <br />located within the MUSA boundary. The property will be served by <br />sewer and water utilities in the spring along with the balance of <br />the plat. The proposed lot meets all requirements for lot width, <br />depth and square foot area. The existing garage on the site will <br />be removed in the spring since the rear lot line will go through <br />the garage. A new garage will be constructed in the near future. <br />The Planning and Zoning Board reviewed the request and concurred <br />with staff in recommending approval of the minor subdivision with <br />the following conditions: <br />1. The newly created lot be made a part of the final plat for <br />the Woods of Baldwin Lake, Second Addition. <br />2. Part Dedication for this lot be included in the overall plat <br />for the Woods of Baldwin Lake, Second Addition. <br />3. Utilities be provided, and assessments collected, as part of <br />the Woods of Baldwin Lake, Second Addition. <br />PAGE 10 <br />
