lt) <br />COUNCIL MEETING FEBRUARY 27, 1995 <br />application. Mr. Brixius explained that since that amendment <br />occurred, the City was challenged for detachment/annexation of <br />properties around the interchange with claims by those property <br />owners that utility services could not be provided by the City. <br />The City won the judgement on this matter by indicating that <br />utilities could be provided. Mr. Brixius said his October report <br />and a number of other items indicated that the timing is <br />appropriate if those features are to be observed. He said that <br />the area is in the MUSA, defense of the annexation position made <br />claim that the City can provide the utility services and <br />according to the City Engineer only a large development that <br />could provide for the financing of the improvements would make <br />utilities to that interchange immediately available. <br />Mr. Brixius noted that the Economic Development Authority <br />Advisory Board (EDAAB) has reviewed the development and has <br />supported it on the basis that providing utilities to the <br />interchange provides for economic development opportunities in a <br />more immediate fashion. Finally the developer did worked with a <br />number of property owners to try and assemble a larger piece of <br />property to make this a more contiguous development. Since then <br />a number of things have changed and the developer is focusing on <br />the 153 lots proposed in the preliminary plat. <br />Mr. Brixius referred to the impact this proposed development will <br />have on the White Bear School District and noted that concerns of <br />this district are the same as for any school district in Lino <br />Lakes. Mr. Brixius also explained that it is not totally within <br />the realm of the authority of the City Council to do much about <br />school district concerns. He noted that claims have been made on <br />the bases of 460 homes. The timing of the 153 homes was not <br />considered and using the reduced number of homes over a larger <br />period of time will allow them to be phased into the school <br />district. In addition, based on the developers projection of <br />$150,000.00 to $300,000.00 homes, the homes will generate taxes <br />in excess of what they will generate in demand for services. Mr. <br />Brixius said there will be some immediate tax benefit through an <br />expanded tax base. He said as noted by a resident of this area, <br />continued growth changes the profile within a school district. <br />Additional families provide additional population base to make <br />corrections within a government jurisdiction much like Lino <br />Lakes. <br />Mr. Brixius said that expansion of economic development to the <br />eastern interchange provides some opportunity for industrial and <br />commercial growth. This type of growth provides tax diversity <br />that has been subjected by the 20/20 Vision Program and also <br />would be supportive of the school district. <br />PAGE 11 <br />1 <br />1 <br />
