18':' <br />COUNCIL MEETING FEBRUARY 27, 1995 <br />Inspector any Ms. Wyland have inspected the site and find it to <br />be in compliance with all applicable requirements. The <br />Conditional Use Permit will be subject to various State <br />Inspections and City review on an annual basis. <br />The Planning and Zoning Board held a Public Hearing on February <br />8, 1995. Condition No. 4 was added as the result of neighborhood <br />concern regarding drainage on the church property. <br />The Planning and Zoning Board and staff recommend approval of the <br />Conditional Use Permit with the following conditions: <br />1. A license from the Minnesota Department of Human <br />Services be maintained at all times. <br />2. Access to the premises be provided upon notification of <br />annual and periodic inspections from appropriate City <br />staff. <br />3. An increase in the number of children to be served in <br />the facility will require modification of the license <br />from the State. Staff would require notification of <br />any increase and inspection by the Building Inspector <br />and Fire Marshall to determine adequacy of structure <br />but waive the requirement of an Amended Conditional Use <br />Permit. <br />4. Staff is to review drainage and grading issues on the <br />church property in the spring. <br />Acting Mayor Neal asked if the drainage concerns are the result <br />of a baseball diamond that was constructed during summer of 1994. <br />Ms. Wyland said yes. Acting Mayor Neal asked Ms. Wyland to <br />explained the inspections of the premises. Ms. Wyland explained <br />and noted that all of the inspections are performed annually. <br />Council Member Kuether moved to approve the Conditional Use <br />Permit subject to the four (4) provisions listed above. Council <br />Member Elliott seconded the motion. Motion carried unanimously. <br />PUBLIC HEARING, IMPROVEMENT OF WOODS OF BALDWIN LAKE, SECOND <br />ADDITION, JOHN POWELL <br />Mr. Powell used the overhead projector and displayed a map of the <br />area to be platted into the Woods of Baldwin Lake, Second <br />Addition. He explained that the preliminary plat was approved <br />with conditions by the City Council on October 24, 1994. In <br />response to a petition received by the City from the property <br />owners within the project area, a report has been prepared <br />evaluating the feasibility of installing public improvement to <br />PAGE 21 <br />
