1 <br />1 <br />1 <br />COUNCIL MEETING FEBRUARY 27, 1995 <br />Consideration of Preliminary Plat, Clearwater Creek - Mr. Brixius <br />asked that the motion to approve the preliminary plat include the <br />11 conditions that are listed in the February 24, 1995 Northwest <br />Associated Consultants (NAC) report. He also suggested that if <br />the Council so desires, item No. 12 could be added requiring the <br />developer and the builder to disclose adjoining land uses. <br />Council Member Bergeson moved to approve the preliminary plat of <br />Clearwater Creek subject to the 11 conditions outlined in the NAC <br />report dated February 24, 1995 plus a 12th condition that the <br />developer either independently or through the RCWD be responsible <br />for cleaning the culvert under Elmcrest Avenue and a 13th <br />condition that the developer or builder disclose the adjoining <br />land use (horse hobby farms) to each purchaser of every lot. <br />Council Member Kuether seconded the motion. On a roll call vote, <br />motion carried unanimously. <br />Consideration of Conditional Use Permit, Kids at Heart Child <br />Care, 7330 Lake Drive - Ms. Wyland explained that the Kids at <br />Heart Child Care Center is located at 7330 Lake Drive in the <br />Gethsemane Methodist Church building. They have been at this <br />site since January, 1992 and hold a license from the State of <br />Minnesota for 35 children. Recently a request was submitted to <br />the State to increase the number of children to 42. The <br />breakdown is as follows: <br />20 Pre -School Children <br />15 School Age Children <br />7 Toddlers <br />2 1/2 to 5 years of age <br />5 to 12 years of age <br />16 months to 2 1/2 years old <br />The Methodist Church's property is zoned Medium Density <br />Residential (R-3) and the Zoning Ordinance provides for day care <br />nurseries (15 children or more) with a Conditional Use Permit. <br />The City staff was asked to review the child care center as a <br />result of the request to increase the number of children to 42. <br />In the review process it was determined that the facility was <br />originally licensed by the State, however a Conditional Use <br />Permit was never required by the City. The applicant has now <br />been required to obtain the necessary Conditional Use Permit. <br />Space has been provided within the church building for a <br />play/fellowship area, nursery, kitchen and rest rooms. A fenced <br />playground on the site is used for outdoor recreation. There are <br />currently four (4) full-time employees and two (2) part-time <br />employees. The facility is open from 6:00 A.M. to 6:00 P.M. <br />Parking in the church parking lot is more than adequate to serve <br />this use. <br />The State Licensing Division, the Fire Marshall, the Building <br />PAGE 20 <br />1 8 4 <br />
