- <br />COUNCIL MEETING MARCH 27, 1995 <br />the Council has had a chance to ask questions about details. He <br />asked that the matter be reviewed at the next work session and <br />then placed on the next Council agenda for the FIRST READING. <br />Mr. Schumacher explained that there are a number of issues tied <br />to this proposed ordinance which impacts current staff discussion <br />with Metropolitan Council. He asked that the FIRST READING be <br />adopted to indicate to Metropolitan Council that the City is <br />attempting to address their concerns. The proposed ordinance can <br />then be brought to the next work session and if further <br />information is needed, the SECONDED READING can be postponed. <br />Mr. Schumacher noted that these are the types of ordinances that <br />Metropolitan Council wants to see moving forward. It would be <br />helpful if at least the FIRST READING of the proposed ordinance <br />is adopted. Council Member Bergeson noted that the City Council <br />is "at the end of the line" and when things do not keep up with <br />the schedule that they should be on, the City Council gets <br />pressed at the end to move faster than they should. He said he <br />did understand the concern regarding Metropolitan Council. <br />Mayor Reinert noted that two (2) public hearings and a special <br />work session of the Planning and Zoning Board were held. He <br />asked Ms. Wyland to explain the reason for the special work <br />session. Ms. Wyland said that the ordinance had been reviewed by <br />the Planning and Zoning Board and then two (2) new members were <br />added to the Board. The reason for the special work session was <br />to update the new members. <br />Mayor Reinert asked if the FIRST READING is adopted this evening, <br />is there a time constraint as to when the SECOND READING should <br />take place. Mr. Schumacher did not recall any restrictions. <br />Mayor Reinert asked about the word "flexibility" and explained <br />that he has received some telephone calls about allowing <br />"flexibility" in the ordinance. Ms. Wyland said that maybe the <br />word "flexibility" should not have been used. She noted in the <br />introduction to communities in the DNR model, there is a <br />statement which reads, "this is the DNR model which is intended <br />to be deviated from". When staff proposed something that was <br />different from the model, it was described as "flexibility". <br />Mr. Brixius explained that the term "flexibility" is a term that <br />was used with the development of state regulations. "The pursuit <br />of flexibility" is a term used by the state in their statutes <br />and with regard to their ordinances. The staff is quoting terms <br />that the state has used because the DNR has to approve the final <br />ordinance and any changes are variations from the standard <br />ordinance and they have termed this "flexibility".
