COUNCIL MEETING MARCH 27, 1995 <br />adopt Resolution No. 95 - 40. Council Member Kuether seconded <br />the motion. Motion carried unanimously. <br />Resolution No. 95 - 40 can be found at the end of these minutes. <br />PUBLIC HEARING, VACATION OF EASEMENT, ROHAVIC OAKS, SECOND <br />ADDITION, RESOLUTION NO. 95 - 41, MARY KAY WYLAND <br />Mayor Reinert opened the public hearing at 7:05 P.M. <br />Ms. Wyland explained that vacation of a drainage easement through <br />Lots 5 and 6, Block 2, Rohavic Oaks, Second Addition is necessary <br />to clear the title for these two (2) properties. The easement <br />was originally recorded as the southwesterly 15 feet of Lot 17, <br />Block 2, Rohavic Oaks. This portion of that plat has been <br />replatted into Rohavic Oaks, Second Addition. However, the <br />original easement was not vacated when the property was <br />replatted. <br />A notice of this hearing has been published as required by City <br />Code. Staff is recommending that the City Council adopt <br />Resolution No. 95 - 41 vacating this easement and directing the <br />Clerk -Treasurer to record the resolution with the County. <br />There was no one in the audience to speak on this matter. <br />Council Member Kuether moved to adopt Resolution No. 95 - 41. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously. <br />Resolution No. 95 - 41 can be found at the end of these minutes. <br />PLANNING AND ZONING BOARD REPORT, MARY KAY WYLAND <br />Consideration of a Conditional Use Permit (CUP) for an <br />Advertising Sign for Contractors Property Developers, Inc. (CPDC) <br />- Ms. Wyland explained that CPDC has requested permission to <br />install an advertising sign for the Pheasant Hills Preserve <br />development on a piece of property located just north and west of <br />the intersection of County Road J (Ash Street) and Centerville <br />Road. The property is zoned Rural and according to the City Sign <br />Ordinance, Section III, Subdivision 2., Sign Requirements in the <br />Rural District: "Advertising Signs: Allowed by Conditional Use <br />Permit.... and Subd. 14; Real Estate Development signs or <br />construction site signs may be erected providing they do not <br />exceed one hundred (100) square feet of area, are not more than <br />fifteen (15) feet above grade, and not within one hundred (100) <br />feet of an existing residential structure..". <br />PAGE 8 <br />1 <br />1 <br />
