COUNCIL MINUTES JULY 28, 1997 <br />Lot 3 = 11,049 sq. ft. of upland with a total area of 50,080 sq. ft. <br />Lot 4 = 10,900 sq. ft. of upland with a total area of 264,297 sq. ft. <br />All lots are designed to meet the minimum width requirement of 80' and are approximately 660 feet in lot depth. <br />Staff has requested that this subdivision be presented as a preliminary plat to provide a cleaner legal description of <br />the property in lot and block fashion rather than by metes and bounds. The developer has agreed to this arrangement <br />although the Zoning Ordinance does provide that a minor subdivision can contain up to four separate lots. Staff <br />recommends approval of this Preliminary Plat with the following conditions: <br />1. The City Engineer review and approve final grading and utilities plans. <br />2. Permits be obtained from the Rice Creek Watershed District. <br />3. Park Dedication be provided as outlined in the City's Park Dedication Ordinance. <br />4. The developer sign a development agreement and post financial guarantees for the extension of utilities <br />to serve the newly created lots. <br />5. Drainage and utility easements are provided along all lot lines and placed over designated wetland areas <br />subject to review and comment by the City Engineer. <br />A public hearing was held before the Planning and Zoning Board on July 9, 1997. At that time the Board <br />recommended approval of the Preliminary Plat with the conditions outlined above. <br />Council Member Kuether asked if the minimum lot size for these lots meets the high ground requirement. Ms. <br />Wyland explained that a small amount of fill will be required on one of the lots, but that with that they will all meet <br />the requirement. <br />Mayor Landers asked if there would be any mitigation with respect to filling. Ms. Wyland responded no. <br />Mr. Schumacher asked if the driveways would be separate, individual driveways or if they would be shared. Mr. <br />Ahrens indicated that each would have its own driveway. <br />Council Member Lyden moved to approve the preliminary plat, 6964 2nd Avenue, subject to the conditions <br />presented. Council Member Neal seconded the motion. Motion carried unanimously. <br />Consideration of FIRST READING, Ordinance No. 20 - 97, Rezone 250 Linda Avenue <br />(4/5ths Vote); Minor Subdivision, 250 Linda Avenue; and Request for Interim MUSA <br />Reserve Designation for 250 Linda Avenue (4/5ths Vote), Mary Kay Wyland - Ms. Wyland <br />explained that this case involves a request for a rezoning, minor subdivision, variance and <br />allocation of less than one acre of interim MUSA reserve to a parcel of property located at the <br />intersection of Linda and Laurene Avenues. The property is currently zoned Rural and is located <br />outside the MUSA. The City's land use map indicates the site as single-family residential. <br />Sewer and water utilities are available to serve this property off both Linda and Laurene <br />Avenues. The location of the property would dictate that in the comprehensive planning process <br />this area would naturally be added to the MUSA and rezoned to R-1 designation, at least to the <br />south line of Lot 2 from Laurene Avenue to Hodgson Road, upon completion of the City's <br />Comprehensive Plan. <br />13 <br />
