COUNCIL MINUTES APRIL 12, 1999 <br />• PUBLIC HEARING, FIRST READING continued from March 22, 1999, Ordinance No. 05 <br />- 99, Vacation of Roadway Easement, Clearwater Creek Phase III, Mary Kay Wyland (4/5 <br />Vote Required) - Ms. Wyland advised that several years ago the property owner recorded a <br />roadway easement to provide access to several parcels of property between Otter Lake Road and <br />Elmcrest Avenue. <br />• <br />• <br />Since that time this property has been sold to make way for the development of Clearwater Creek <br />3rd Addition. In order to plat the Clearwater Creek 3rd Addition, the existing roadway <br />easements through this area of the development must be vacated. <br />Mayor Sullivan opened the public hearing at 9:22 p.m. <br />Council Member Lyden moved to close the public hearing at 9:23 p.m. Council Member Dahl <br />seconded the motion. Motion carried unanimously. <br />Council Member Lyden moved to approve the FIRST READING o d ce 1 05 - 99, as <br />presented. Council Member Neal seconded the motion. <br />Council Member Bergeson voted yes. Council Member Dahlioted es ouncil Member <br />Lyden voted yes. Council Member Neal voted yes Mayor ullivan voted yes. <br />Motion carried unanimously. <br />SECOND READING, Ordinanc No.4 99, Exchange of Property with James and Tracy <br />Douglas, John Powell - Mr. Pow dvifid Ori lance No. 04 - 99 received its first reading at <br />the March 22, 1999, Co s cel <br />The Ordinance transfe <br />Utility and Apollo riv <br />ames and Tracy Douglas as part of the Lake Drive Trunk <br />Council Memb "ahl moved to approve the SECOND READING of Ordinance No. 04 - 99, as <br />presented. Council Member Neal seconded the motion. <br />Council Member Bergeson voted yes. Council Member Dahl voted yes. Council Member <br />Lyden voted yes. Council Member Neal voted yes.
