COUNCIL MINUTES APRIL 12, 1999 <br />responsible for the property. He advised it is not a common problem as residents most often <br />want to take care of the property. The City can detail how it wants the open space maintained. <br />Mayor Sullivan asked if the City can establish an escrow to cover any City maintenance costs <br />and to cover any costs associated with City action to enforce the contract. Mr. Hawkins stated he <br />would have to investigate the process of setting up an escrow situation. It is possible the City <br />could levy assessments to cover the costs of cleaning up neglected areas. There will be a <br />mechanism in place for the homeowners association to collect a fee from the homeowners for <br />maintenance. <br />Council Member Lyden stated he supports the option of the City owning and managing the open <br />space for the good of the City. Conflicts and certain issues will be avoided if the City owns the <br />property. <br />Mr. Asleson stated he referred to 1995 figures regarding the maintenance native materials. <br />The cost is approximately $72.00 per year, per household, after the initial i tallation. That <br />figure includes maintenance and labor. <br />Council Member Neal asked about the possibility of the l <br />fee. Mr. Smyser stated the homeowners association can <br />wne of p ging an association <br />ten on the residents property. <br />Council Member Lyden asked about the phasing schedule.He stated MUSA is not an issue for <br />the first phase. He indicated he suppo theirezone and phasing. He asked at what point is it <br />responsible to open the next phase fore d ng <br />Mr. Smyser advised the <br />each year. Mr. Hawkins advised the number of building permits issued can be limited if it <br />is a condition of approval. <br />Mayor Sullivan stated she cannot support the project if 25% of it is cut off. It is expected that the <br />Comprehensive Plan will be approved. She indicated she is very uncomfortable approving only <br />75% of a project if the Plan is not approved. She stated she does understand and shares the <br />MUSA concern. She stated the project is acceptable. However, she stated she would have rather <br />seen all the information before approval.
