CITY COUNCIL WORK SESSION MAY 4,1999 <br />curb cuts can be smaller depending on the wishes of the homeowner or the space <br />available. All setback requirements have been met in this new plan. <br />Mr. Steve Arndorfer, developer for the project, stated the initial reaction to shared <br />driveways was negative. The biggest issue is snowplowing. However, with a <br />development this small it should not be a problem. A homeowners association could be <br />created if necessary, however, he preferred that it not be mandatory. <br />There will be an easement around the ponds to protect them. The City Attorney has <br />indicated every easement is different and there is no set form for creating easement <br />restrictions. Staff is recommending the following easement restrictions: no cutting of the <br />grass, no buildings, all natural vegetation must be left in place, and a list of acceptable <br />plantings be prepared. City staff should visit the site yearly to insure compliance with the <br />easement restrictions. <br />Council asked the following items be reviewed before Council action on the plan: <br />driveway width should be between 20' and 24', garage placement, a draf of the easement <br />description, and a requirement that the disclosure agreement must b every time <br />the property is sold. <br />This item will appear on the agenda at the regular C it ee day, May 10, <br />1999. <br />CENTENNIAL SCHOOL ASSES ' POWELL <br />Mr. Powell distributed an <br />utility improvements. <br />properties and w <br />w ' r the Centennial Middle School street and <br />o a map which showed the location of benefiting <br />The final assessm'ndicated that PIN #17-31-22-33-0005 was owned by ISD #12. <br />However, the pro . ' is actually owned by Glenn Rehbein. The Centennial School <br />District and Mr. Rehbein have been made aware of the error and that corrections are <br />being prepared. Staff is recommending that a refund be paid to the Centennial School <br />District and an assessment be certified to Mr. Rehbein's property. <br />This item will appear on the Consent agenda at the regular Council meeting Monday, <br />May 10, 1999. <br />DISCUSS CENTENNIAL SCHOOL DISTRICT LEASE AMENDMENT, LINDA <br />WAITE SMITH <br />Ms. Waite Smith explained that the occupancy of the Early Childhood Learning Center <br />was delayed. Because of this delay, the original lease dates are incorrect. The City <br />Attorney has prepared a lease amendment with the correct dates. <br />2 <br />
