She was in attendance and requested Council take action to reduce the <br />noise from the operation of the track. <br />The BMX track has a conditional use permit (CUP). Staff has investigated the facility to <br />make sure that it is operating within the limits of the CUP. The problem is that the <br />Baumann's stopped calling the Police Department every time they felt a violation was <br />occurring. The Police Department must come and write a report otherwise it appears that <br />there have been no complaints. Ms. Baumann explained that she stopped calling the <br />Police Department. <br />Ms. Baumann noted that recently a loud bobcat type machine has been running steady <br />from about 3:00 p.m. to about 9:30 p.m. outside of the arena every day. The noise has <br />made it impossible to use her backyard. In addition, the noisy gate that was to be replaced <br />is still making loud noises. <br />Staff explained that since the bobcat is not a construction machine, the olicy regarding <br />the operation of construction equipment does not apply. <br />Staff was directed to discuss this matter with the BMX trac <br />they are aware of all noise restrictions listed in the CUP <br />contact Ms. Baumann to let her know what section <br />this situation. <br />Council directed staff to review the C c <br />be added to this particular CUP. <br />This matter will be on the <br />ake sure that <br />ode. When all <br />information is received, he will prepare a recommendation for Council to consider. This <br />matter will be removed from the agenda Monday evening. <br />Regular Agenda - Mr. Powell reviewed the items that he will present to the Council on <br />Monday evening. <br />AMERICAN LEGION LAND PURCHASE UPDATE, BRIAN WESSEL <br />A land appraisal for the four (4) lots owned by the City along Lake Drive was presented <br />to Council at the May 19, 1999 work session. The Blaine Legion Club has an option to <br />buy the lot and building formerly used by the Police Department. This lot was appraised <br />at $82,500 without assessments.
