Melton, the owners of Lot 2, Block 1, Oak <br />Brook Peninsula, are requesting the vacation of a portion of the City's drainage and utility <br />easement which contains a hockey rink constructed by the Melton's. The vacation of <br />about 3,500 square feet of the easement would reduce the flood storage capacity <br />easement by about 20%. <br />This drainage and utility easement was dedicated for at least three purposes: storm sewer <br />area, "wet" pond, and to provide compensatory flood storage adjacent to Otter Lake. <br />Staff recommended that the request to vacate a portion of the easement be denied because <br />it is not in the best interest of the City. If the rink remains intact, the developer cannot <br />properly excavate the storage pond. <br />Mr. Melton stated the rink is positioned in the woods on his property. He noted that there <br />is no other location for the rink. He constructed the rink so his son and other children in <br />the area would have a place to play hockey because there is no another recreational area <br />in the vicinity. He also noted that the rink is not a permanent structure. Mr. Melton <br />requested the opportunity to work with the City to keep the rink intact for the community. <br />Council directed staff to determine if a building permit was needed for the rink. <br />Ms. Julie Schwartz, a resident opposed to the rink, suggested the City purchase the rink <br />and put it in the Clearwater Creek subdivision. <br />
