The <br />conditions should repeat those approved at the time of preliminary plat and add conditions about <br />the revised plat drawing, title page, title commitment, and the developer's agreement. This <br />would once again show the City's good faith in doing everything the City can do to keep the <br />project moving. <br />Staff added that issue causing the most concern is the developer's agreement relating to the <br />private road. The developer would like to construct the road himself and have it remain private <br />until it extends to 77th Street. <br />Council expressed concern regarding the number of outstanding issues. The City does not have a <br />good track record regarding outstanding issues being completed. <br />Staff advises all the outstanding issues must be completed quickly to make this project a reality. <br />Because time is an issue, staff recommended approval based on the completion of the <br />outstanding issues. <br />The City Attorney advised the approval could be contingent on c i The final plat <br />would not be officially approved until all tasks are complete as for approval with the <br />conditions is the time element. <br />Mr. Tim Baylor, Developer for the project, came <br />constraint. The road <br />has to be a public road for access to future development. <br />Mr. Baylor stated the language in the original agreement does convey that it will be public in the <br />future at no cost to the City. The concern is when the road will become public. <br />Mayor Sullivan suggested this item be tabled because of too many loose ends. Staff noted most <br />of the outstanding issues can be completed very quickly. The main issue is the private road and <br />when it will become public. Staff recommended approval so both parties are motivated to <br />complete the tasks. Council may put a time limit on completion of the outstanding issues. <br />
