JADT feels they should be <br />compensated for development of the road. Typically, it is the City's policy to not <br />compensate developers for road construction. The City does not have any other funding <br />available for development of the road. <br />The City Attorney continued stating that staff is recommending Chapter 429 assessment <br />and/or eminent domain process begins for the City to develop the road. The City will <br />then assess the benefiting properties. For development to begin in the spring, the process <br />should begin now. <br />Mr. Baylor stated he is encouraged that the City has interest in accessing the property for <br />further development. He noted that he had requested City help in developing the road in <br />1998. He expressed concern regarding the 429 option and why it had not been presented <br />1 <br />
